An ordinance accepting an easement from CSX Transportation, Inc., on a parcel of property for use in the greenway system.

Whereas, pursuant to the terms of the document attached as Exhibit A to this ordinance, CSX Transportation, Inc., has agreed to donate to the Metropolitan Government an easement ("Easement") on a certain parcel of property abutting Richland Creek; and

Whereas, the easement will be used to construct, operate and maintain portions of the greenway system; and

Whereas, the citizens of Nashville and Davidson County will benefit by accepting the donated easement.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The donation of the Easement as proposed in Exhibit A is hereby accepted.

Section 2. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
