ORDINANCE NO. BL2002-932

An ordinance approving participation by the members of the Metropolitan Board of Public Education in the Insurance Trust insurance plan during the members' terms of office.

Whereas, the Tennessee General Assembly has amended T.C.A.§8-27-303(a)(3) to make eligible for the state insurance plan members of boards of education in participating districts; and

Whereas, the Metropolitan Board of Public Education ("the Board") wishes to extend to its members the same opportunity for insurance coverage now afforded to members of boards of education functioning under the state insurance plan; and

Whereas, the Board is not a participant in the state insurance plan but rather administers its own plan, the Insurance Trust, pursuant to T.C.A.§8-27-303(a)(2); and

Whereas, the Board voted on December 11, 2001, to amend the eligibility requirements for participation in the Insurance Trust to permit the inclusion of the members of the Board during their terms of office; and

Whereas, T.C.A.§49-2-202(d) requires the approval of the county legislative body before compensation may be made to members of its local board of education; and

Whereas, insurance coverage is a form of compensation.

Now, therefore, be it enacted by the Metropolitan Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: That the action by the Board amending the eligibility requirements of the Insurance Trust to allow Board member participation during each member's term of office is hereby approved. The Board is authorized to take all steps necessary to complete such changes in the insurance plan to allow participation by Board members now and in the future.

Section 2: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
