Metropolitan Council Meeting
Tuesday, July 3, 2001


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Chaplin Donald Moorehead.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Ferrell, Waters, Briley, Gentry, Tucker, Gilmore, Black, Majors, Hall, Hart, Dillard, Balthrop, Brown, Ponder, Derryberry, Stanley, Loring, McClendon, Greer, Hausser, Wallace, Haddox, Whitmore, Hand, Bogen, Summers, Shulman, Arriola, Alexander, Holloway, Kerstetter, Knoch, Jenkins, Turner, Williams, Lineweaver, and President Steine (37); Absent: Nollner, Beehan, Campbell, Sontany (4).

The Minutes of the adjourned meeting of June 26, 2001 were approved.

The President announced that the time of the Council meeting on August 7, 2001 will be changed to 8:00 p.m. to accommodate Nashville's Night Out Against Crime.

Dear Vice Mayor Steine:

For the reasons outlined in the attached memorandum by Metro Legal Director Karl Dean, I am returning BL2001-711 with my veto. I reluctantly exercise this authority but believe it to be the appropriate action given the process and liability issues involved.

Because of my respect for the intentions of the sponsors and councilmembers, as well as the appropriation of partial funding for this purpose, I have directed Police Chief Emmett Turner to develop a policy for properly honoring our disabled police officers. I have asked him to report back to us his plans in this regard this summer.

- ELECTIONS AND CONFIRMATIONS -

Metropolitan Action Commission
Appointment of Ms. Zulma Rivera to the Metropolitan Action Commission for a term expiring February 2, 2004. In the absence of the appointee, the confirmation was deferred without objection.

Metropolitan Board of Health
Reappointment of Dr. Sam Okpaku to the Metropolitan Board of Health for a term expiring July 9, 2006. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Mr. Ferrell moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

BILL NO. BL2001-743

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the preliminary plan of the Residential Planned Unit Development District located abutting the northeast margin of Highway 100, 400 feet northeast of Old Hickory Boulevard, classified R20 District and proposed for RM4 District, to develop 120 townhomes and three single-family lots and revise the site layout to create a public street connection to the west through parcel 21 to Highway 100, replacing 86 townhomes and three single-family lots, (31.10 acres), (Proposal No. 97P-030G-06), all of which is more particularly described herein. The bill was disapproved by the Planning Commission. Mr. Lineweaver moved to defer action indefinitely and re-refer the bill to the Planning Commission, the bill being requested by William E. Kantz, Jr., which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-744

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, Section 17.16.060.B (Uses Permitted with Conditions: Medical Uses-Veterinarian), by establishing a new measure for building bulk and clarifying the standards for boarding of companion animals as an accessory use to veterinary clinics (2001Z-004T), all of which is more particularly described herein. The bill was deferred indefinitely by the Planning Commission. Mr. Lineweaver moved to defer action on the bill to the public hearing in September, which motion was seconded and adopted by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by restricting the location of billboards in Planned Unit Developments (PUDs), (2001Z-001T), all of which is more particularly described herein. The bill was approved by the Planning Commission. Mr. Ponder requested a hearing from the public on this bill which had been previously advertised. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by adding provisions for accessory dwelling units in certain residential districts subject to the Urban Zoning Overlay District (2001Z-002T), all of which is more particularly described herein. Mr. Ponder moved to defer action on the bill to the public hearing in September, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-747

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by modifying certain site plan review requirements for Community Education uses (2001Z-005T), all of which is more particularly described herein. Mr. Ponder moved to defer action on the bill to the public hearing in September, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-748

An ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, by amending Section 17.08.030 and Section 17.16.220 by permitting temporary festivals in the agricultural districts as a special exception, all of which is more particularly described herein. Mr. Lineweaver moved to defer action indefinitely on the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-754

An ordinance approving a lease of premises by The Metropolitan Government of Nashville and Davidson County, acting through the Metropolitan Board of Fair Commissioners, to Senior Citizens, Inc. for a Senior Citizens Center. The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Codes, Fair and Farmers Market, and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2001-755

An ordinance approving the transfer of certain property owned by The Metropolitan Government of Nashville and Davidson County to the Metropolitan Development and Housing Agency (part of property known as Boyd Park; Tax Map 92-5, part of Parcel 33). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Budget and Finance and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2001-756

An ordinance accepting a grant from the State of Tennessee, Department of Transportation to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Historical Commission, in an amount not to exceed $250,000 for the Hermitage Replanting Project. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2001-757

An ordinance approving a contract between The Metropolitan Government of Nashville and Davidson County and The Hermitage for the implementation of an activity of the Surface Transportation Program, administered by the State of Tennessee, Department of Transportation for the replanting of trees at The Hermitage. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Parks, Library, Recreation and Auditorium Committees by a voice vote of the Council.
