ORDINANCE NO. BL2001-754

An ordinance approving a lease of premises by The Metropolitan Government of Nashville and Davidson County, acting through the Metropolitan Board of Fair Commissioners, to Senior Citizens, Inc. for a Senior Citizens Center.

Whereas, the Metropolitan Board of Fair Commissioners and Senior Citizens, Inc. have negotiated a ground lease for premises located on the property commonly known as the Tennessee State Fairgrounds (hereinafter "Fairgrounds"); and,

Whereas, the lease provides that Senior Citizens, Inc. will erect, operate, and maintain a senior citizens center to be used as a civic and activity center for senior citizens in a manner that will not interfere with the annual Tennessee State Fair; and,

Whereas, the Metropolitan Charter grants the Metropolitan Board of Fair Commissioners the authority to lease the Fairgrounds for amusement purposes; however, the use of the Senior Citizens Center will not be restricted to amusement purposes; and,

Whereas, it is therefore proper for the Metropolitan Council to approve the lease as provided in Section 2.24.210 of the Metropolitan Code; and,

Whereas, the lease agreement between the Metropolitan Board of Fair Commissioners and Senior Citizens, Inc. is in the public interest.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: That the Ground Lease of the premises located on the Tennessee State Fairgrounds, by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Fair Commissioners, and Senior Citizens, Inc., for a term of forty (40) years and for rent at the rate of One Dollar ($1.00) per year, which lease is attached hereto and incorporated by reference, be and the same is hereby approved.

Section 2: That the Ground Lease approved herein may be amended subject to approval by resolution receiving 21 votes.

Section 3: This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
