ORDINANCE NO. BL2001-757

An ordinance approving a contract between The Metropolitan Government of Nashville and Davidson County and The Hermitage for the implementation of an activity of the Surface Transportation Program, administered by the State of Tennessee, Department of Transportation for the replanting of trees at The Hermitage.

Whereas, The Hermitage wishes to participate in the implementation of the Surface Transportation Program funded by the State of Tennessee for the replanting of trees on the grounds of the Hermitage lost by tornado damage; and

Whereas, the State of Tennessee requires that a governmental entity accept and distribute the funds for this program; and

Whereas, the State of Tennessee, Department of Transportation and The Metropolitan Government of Nashville and Davidson County are entering a grant agreement for acceptance of said funds to be distributed to the Hermitage for the tree replanting project; and

Whereas, The Metropolitan Government of Nashville and Davidson County and the Hermitage have negotiated an agreement for the receipt of these funds and implementation of the tree replanting project in accordance with the terms set forth by the State of Tennessee, Department of Transportation;

Whereas, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this contract be approved.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the contract by and between The Metropolitan Government of Nashville and Davidson County and the Hermitage for the replanting of trees lost by tornado damage and in accordance with the terms set forth by the State of Tennessee, Department of Transportation, a copy of which is attached hereto and incorporated herein, is hereby approved.

Section 2. That any amendments to this contract shall be approved by resolution by twenty-one affirmative votes of the Metropolitan Council.

Section 3. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
