ORDINANCE NO. BL2001-755

An ordinance approving the transfer of certain property owned by The Metropolitan Government of Nashville and Davidson County to the Metropolitan Development and Housing Agency (part of property known as Boyd Park; Tax Map 92-5, part of Parcel 33).

WHEREAS, The Metropolitan Government of Nashville and Davidson County owns a certain parcel of property (Tax Map 92-5, Parcel 33) known as Boyd Park; and

WHEREAS, it has been determined by survey that a part of the Preston Taylor Community Center encroaches onto said property; and

WHEREAS, the Metropolitan Development and Housing Agency requested that .067 acres (2,910 square feet) of the above mentioned parcel, as shown on Exhibit A, be transferred to correct said encroachment; and

WHEREAS, the Board of Parks and Recreation approved that request at its meeting on June 5, 2001; and

WHEREAS, the Director of Public Property Administration is authorized to transfer property, subject to the approval of the Metropolitan County Council and Mayor.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. The Metropolitan County Council declares that the following area of land owned by the Metropolitan Government to be surplus:

a portion of Boyd Park
0.067 acres (2,910 square feet)
Tax Map 92-5, part of Parcel 33

SECTION 2. The Director of Public Property Administration is hereby directed to transfer said property listed above to the Metropolitan Development and Housing Agency and is hereby authorized to execute the necessary documents pertaining thereto.

SECTION 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
