Metropolitan Council Meeting
Tuesday, May 1, 2001


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilmember Phil Ponder.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Ferrell, Waters, Briley, Gentry, Tucker, Black, Nollner, Majors, Hall, Beehan, Campbell, Hart, Balthrop, Brown, Ponder, Stanley, Loring, McClendon, Greer, Hausser, Wallace, Haddox, Whitmore, Hand, Bogen, Summers, Shulman, Arriola, Sontany, Alexander, Holloway, Knoch, Turner, Williams, Lineweaver, and President Steine (38); Absent: Gilmore, Dillard, Derryberry, Kerstetter, Jenkins (5).

The Minutes of the regular meeting of April 17, 2001 were approved.

- COMMITTEE REPORTS ON MATTERS OTHER THAN LEGISLATION -

The Rules-Confirmations-Public Elections Committee recommended deferment of the proposed amendments to Rule Nos. 20 and 27 of the Rules of Procedure of the Metropolitan Council. Mr. Ferrell moved to defer the amendments, which motion was seconded and adopted without objection.


- ELECTIONS AND CONFIRMATIONS -

Planning Commission

Appointment of Mr. Stewart Clifton to the Planning Commission for a term expiring March 31, 2005. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Mr. Ferrell moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Board of Plumbing Examiners & Appeals

Appointment of Mr. Brian Tibbs to the Board of Plumbing Examiners and Appeals for a term expiring March 10, 2005. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Mr. Ferrell moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Traffic & Parking Commission

Reappointment of Ms. Barbara Toms to the Traffic and Parking Commission for a term expiring April 3, 2006. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Mr. Ferrell moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CL District to CS District property at 623 Old Hickory Boulevard, approximately 400 feet south of Interstate 40 (.95 acres), (Proposal No. 2001Z-020G-06), all of which is more particularly described herein. The bill was approved by the Planning Commission. Mr. Bogen requested a hearing from the public on this bill which had been previously advertised. BILL NO. BL2001-653

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the existing Commercial (General) Planned Unit Development District located abutting the west margin of Old Hickory Boulevard, 400 feet south of Interstate 40 (3.36 acres), classified CL and proposed for CS District, to add .95 acres and a 10,900 square foot autobody shop, (Proposal No. 88P-040G-06), all of which is more particularly described herein. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by applying a Planned Unit Development District to property located along the west margin of Old Hickory Boulevard, approximately 2,000 feet south of Ridgelake Parkway (58.81 acres), classified within the R15 and R20 Districts and proposed for RM4 District, to permit 130 condominium units, a clubhouse, and 42 acres of open space within three development phases, (58.81 acres), (Proposal No. 2001P-003G-06), all of which is more particularly described herein. The bill was disapproved by the Planning Commission. Mr. Bogen requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill, and a citizen was heard in favor of the bill. The President declared the public hearing closed. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R8 District to IWD District properties at 2927, 2929, 2931, and 2937 Brick Church Pike, opposite Brick Church Park Drive (12.21 acres), (Proposal No. 2001Z-030U-03), all of which is more particularly described herein. The bill was approved by the Planning Commission. Mr. Black requested a hearing from the public on this bill which had been previously advertised. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending a portion of the preliminary plan of the Residential Planned Unit Development District located on Nocturne Forest Drive between Old Buena Vista Pike and Whites Creek Pike, approximately 1,200 feet north of West Trinity Lane, classified RS15 District, to redesign a portion of the single-family lots in Phase 2 and to eliminate the connection of Nocturne Forest Drive, to Old Buena Vista Pike, (5.0 acres), (Proposal No. 77-87-P-03), all of which is more particularly described herein. BILL NO. BL2001-657

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R8 District to RM40 District properties at 2112 and 2114 Buena Vista Pike, approximately 440 feet east of Clarksville Pike (2.21 acres), (Proposal No. 2001Z-036U-03), all of which is more particularly described herein. The bill was disapproved by the Planning Commission. Mr. Black requested a hearing from the public on this bill which had been previously advertised.
