ORDINANCE NO. BL2001-673

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by applying a Planned Unit Development District to property located abutting the east margin of Murphy Court and the south margin of Murphy Road, classified CS District and proposed for ORI District, (1.46 acres), to permit an 89,507 square foot, 121 room, 6-story hotel, (Proposal No. 2001P-005U-10), all of which is more particularly described herein.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, be and is hereby amended by making certain changes in the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of said Title 17 by reference, as follows:

By applying a Planned Unit Development District to property located abutting the east margin of Murphy Court and the south margin of Murphy Road, classified CS District and proposed for ORI District, (1.46 acres), to permit an 89,507 square foot, 121 room, 6-story hotel, being more particularly described as being Property Parcel Nos. 58, 59, and 60 as designated on Map 104-6 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is more particularly described by lines, words and figures on the attached plan, which is attached to and made a part of this ordinance as though copied herein.

SECTION 2. BE IT FURTHER ENACTED, That the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Sheet No. 104 of said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

SECTION 3. BE IT FURTHER ENACTED, That this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

TO

ORDINANCE NO. BL2001-673


Mr. President:

I move to amend Ordinance No. BL2001-673 by modifying the bill to add three (3) conditions of approval to Section 2 of the bill and renumber the remaining sections:

The following conditions shall apply to any final PUD plan:

1. At a minimum, the facade of the hotel structure shall be red brick on the first-floor, including the rear and all sides of the building at the first-floor level.

2. One double-faced, ground monument sign not exceeding 6 feet in total height and 30 square feet in sign area shall be permitted on Murphy Road. The sign shall be supported by a solid base of brick. The brick shall be of the same color used on the hotel structure's facade as provided in "1" above.

3. Two wall-mounted signs shall be permitted on the building's facades. No pole-mounted sign(s) shall be permitted anywhere within the boundary of the Planned Unit Development Overlay District.
