Minutes Metropolitan Council Meeting |
The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.
The invocation was offered by Josh Rodriquez, Youth Adult Ministry, First Presbyterian Church of Nashville.
The Metropolitan Council gave the pledge of allegiance to the American Flag.

The Minutes of the regular meeting of May 16, 2017 were approved.
- ELECTIONS AND CONFIRMATIONS –
Cheatham County Rail Authority
The President announced that an election would be conducted to fill a two-year term expiring June 6, 2019, on the Cheatham County Rail Authority and that the name of Mr. Ed Cole had been submitted in nomination for the position. Mr. Shulman reported that the Committee had considered and found Mr. Cole to be qualified.
Nashville and Eastern Rail Authority
The President announced that an election would be conducted to fill a two-year term expiring June 6, 2019, on the Nashville and Eastern Rail Authority and that the name of Mr. Jeff Syracuse had been submitted in nomination for the position. Mr. Shulman reported that the Committee had considered and found Mr. Syracuse to be qualified.
Mr. Shulman moved for the election of Mr. Cole and Mr. Syracuse by acclamation, which motion was seconded and unanimously adopted.
Metropolitan Nashville Airport Authority
Appointment of Ms. Christy Smith for a term expiring June 4, 2021. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
Human Relations Commission
Appointment of Mr. Will Leavitt for a term expiring April 18, 2019. Mr. Leavitt will fill the unexpired term of Mr. Frank Trew. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
Plumbing Examiners and Appeals Board
Appointment of Ms. Rhonda Weatherford for a term expiring March 10, 2020. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
- BILLS ON PUBLIC HEARING AND SECOND READING -
A bill to be entitled: The Budget Ordinance of the Metropolitan Government of Nashville and Davidson County, Tennessee for Fiscal Year 2018. Mr. Cooper requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. The President declared the public hearing closed. The bill was approved by the Budget and Finance Committee. Mr. Cooper moved to pass the bill on second reading and re-referred the bill to the Budget and Finance Committee, which motion was seconded and approved by a voice vote of the Council.
An ordinance adopting the 2017-2018 through 2022-2023 Capital Improvements Budget for The Metropolitan Government of Nashville and Davidson County as the official Capital Improvements Budget of The Metropolitan Government of Nashville and Davidson County for Fiscal Year 2017-2018. The bill was approved by the Planning Commission. Mr. Cooper requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in opposition to passage of the bill. The President declared the public hearing closed. The was approved by the Budget and Finance and Planning, Zoning, and Historical Committees. - CONSENT AGENDA RESOLUTIONS -
A resolution accepting a grant from the State of Tennessee, Department of Mental Health and Substance Abuse Services, to The Metropolitan Government of Nashville and Davidson County for the State Trial Courts to provide the Tennessee Certified Recovery Court Program (TCRCP) to enable the provision of adult and juvenile drug court programs to address the needs of non-violent offenders. The resolution was approved by the Budget and Finance Committee.
A resolution approving an application for a Victim Service Coordinators Grant from the State of Tennessee, Office of Criminal Justice Programs, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Office of Family Safety, for funding three victim coordinator positions to assist victims of domestic violence and sexual assault. The resolution was approved by the Budget and Finance Committee.
A resolution authorizing the execution and delivery of an economic development incentive grant agreement between The Metropolitan Government of Nashville and Davidson County and Music City Productions, Inc., the company which produces the television show, Nashville. The resolution was approved by the Budget and Finance and Convention, Tourism, and Public Entertainment Facilities Committees.
A resolution approving the salary for the Chief Medical Director of The Metropolitan Government of Nashville and Davidson County. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.
A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, for family planning services. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.
A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to achieve sustained tuberculosis control and enhanced tuberculosis prevention to eventually eliminate tuberculosis as a public health threat in Tennessee. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.
A resolution approving an intergovernmental agreement and amendments by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department (hereinafter “MNPD”), and the U.S. Army Corps of Engineers for extra-duty police services. A resolution authorizing the Metropolitan Department of Law to compromise and settle the medical malpractice claim of Valda Banks as administratix ad litem of the Estate of Thomas Bowers against the Metropolitan Hospital Authority and the Metropolitan Government of Nashville and Davidson County in the amount of $250,000.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.
A resolution authorizing the Metropolitan Department of Law to compromise and settle the property damage claim of George Brandt against the Metropolitan Government of Nashville and Davidson County in the amount of $30,618.81, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.
A resolution authorizing the Metropolitan Department of Law to compromise and settle the medical malpractice claim of Jacqueline Hoskins as administrator ad litem of the estate of Everett W. Vest, III, deceased, against the Metropolitan Hospital Authority of the Metropolitan Government in the amount of $180,000.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.
A resolution authorizing the Metropolitan Department of Law to compromise and settle the claims of William James McGilmer against Officer Dezmond Hughes, in the amount of $11,500.00 and that said amount be paid out of the Judgments and Losses Fund.
The resolution was approved by the Budget and Finance Committee.
A resolution requesting that the Metropolitan Department of Codes Administration prepare, and the Office of the Trustee distribute, a flyer advising non-mortgaged homeowners of the most common Property Standards and Zoning Codes violations. The resolution was approved by the Codes, Fair, and Farmers Market Committee.
A resolution requesting that the Metropolitan Department of Codes Administration revise its Landlord Registration Form in order to gather additional information to facilitate contacting rental property landlords when violations or enforcement issues arise. The resolution was approved by the Codes, Fair, and Farmers Market Committee.
A resolution honoring American astrophysicist and science communicator Dr. Neil deGrasse Tyson and his advocacy for environmental science upon his arrival to Nashville, Tennessee on June 14, 2017. The resolution was approved by the Codes, Fair, and Farmers Market Committee.
A resolution recognizing Thursday, June 1 to Friday, June, 30, 2017 as “Nashville Pride Month”, celebrating the Lesbian, Gay, Bisexual and Transgender communities and their enormous contributions to the quality of life in Nashville and Davidson County.

A resolution establishing the certified tax rate in the General Services District, and declaring the amount of the certified rate for the Urban Services District, pursuant to the provision of Tennessee Code Annotated,§ 67-5-1701, et seq. The Budget and Finance Committee recommended deferral.
A resolution approving the Metropolitan Animal Care and Control fee schedule. The resolution was approved by the Health, Hospitals, and Social Services Committee. The Budget and Finance Committee recommended deferral.
A resolution adopting new pay plans for the general employees of the Metropolitan Government of Nashville and Davidson County, excluding employees of the Board of Health, Board of Education, and the Police and Fire Departments, effective July 1, 2017, July 1, 2018, and July 1, 2019; and establishing the salaries for the Public Defender, Vice Mayor and members of the Metropolitan Council, effective upon the beginning of a new elective term of that office. An initial resolution determining to issue general obligation bonds of The Metropolitan Government of Nashville and Davidson County in an aggregate principal amount of not to exceed Two Hundred Eighty-Eight Million Dollars. The Budget and Finance Committee recommended deferral to the June 13 adjourned meeting. Mr. Cooper moved to defer the bill to the adjourned meeting on June 13, which motion was seconded and approved by a voice vote of the Council.
A resolution authorizing the Director of Public Property, or his designee, to exercise an option to purchase a portion of real property (Map 092-08-0 Parcels 103.00, 104.00 & 105.00) for the use and benefit of the Metropolitan Nashville Public Schools (Proposal No. 2017M-031PR-001). The resolution was approved by the Planning Commission, Budget and Finance, Education, and Planning, Zoning, and Historical Committees with an amendment. Mr. O’Connell offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. An ordinance to amend Title 11 of the Metropolitan Code of Laws regarding federal civil immigration laws. Upon motion duly seconded, the bill passed first reading and was referred to the Public Safety, Beer, and Regulated Beverages Committee by a voice vote of the Council with Mr. Swope voting no.
An ordinance amending Chapter 12.52 of the Metropolitan Code of Laws establishing a right for pedestrians to the use of certain streets.
