ORDINANCE NO. BL2017-732

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sanitary sewer main, sanitary sewer manholes and easements and to accept a new sanitary sewer manhole and any associated easements, for property located at 2400 Gallatin Pike (MWS Project No. 16-SL-243 and Proposal No. 2017M-039ES-001).

WHEREAS, the abandonment of approximately 412 linear feet of existing sanitary sewer main, three sanitary sewer manholes and easements and the acceptance of a new sanitary sewer manhole and any associated easements, for property located at 2400 Gallatin Pike, are needed to construct project number 16-SL-243; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2017M-039ES-001 on April 12, 2017, for the abandonment and acceptance of said sanitary sewer main, sanitary sewer manholes and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 412 linear feet of existing sanitary sewer main, three sanitary sewer manholes and easements, and to accept a new sanitary sewer manhole and any associated easements, for property located at 2400 Gallatin Pike, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
