ORDINANCE NO. BL2017-748

An ordinance approving a lease agreement between the Metropolitan Government of Nashville and Davidson County and Due West Towers, LLC for temporary office space at 610 Due West Avenue, Madison, Tennessee 37115 (Proposal No. 2017M-034PR-001).

WHEREAS, Due West Towers, LLC owns certain real property located at 610 Due West Avenue, Madison, TN 37115; and,

WHEREAS, The Metropolitan Government of Nashville and Davidson County has determined that this property is needed to provide space for offices for the Davidson County Sheriff’s Office (“DCSO”); and,

WHEREAS, The Metropolitan Government and Due West Towers, LLC have negotiated the attached Lease Agreement attached as Exhibit 1.

WHEREAS, approval of this Lease Agreement is in the best interest of the citizens of the Metropolitan Government.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Lease Agreement between the Metropolitan Government of Nashville and Davidson County and Due West Towers, LLC, attached hereto as Exhibit 1 and incorporated herein, is hereby approved and the Director of Public Property is authorized to execute said Lease Agreement.

Section 2. Any amendments to the Lease Agreement may be approved by resolution of the Metropolitan Council receiving at least twenty-one (21) affirmative votes.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
