RESOLUTION NO. RS2017-742

A resolution requesting that the Metropolitan Department of Codes Administration revise its Landlord Registration Form in order to gather additional information to facilitate contacting rental property landlords when violations or enforcement issues arise.

WHEREAS, in an effort to maintain and improve the quality of housing, Tennessee Code Annotated § 66-28-101 et seq. (“Uniform Residential Landlord and Tenant Act”) requires all owners of residential rental property to register their property with the department of local government responsible for enforcing building codes; and

WHEREAS, the Metropolitan Department of Codes Administration established the Landlord Registration Program to enable owners to register their property by completing the Landlord Registration Form. (See, sample, attached hereto as an exhibit); and

WHEREAS, the Landlord Registration Form currently requires owners to provide contact information, including name, home address, phone number, and email address, to be used in the event of a Department of Codes Administration violation that requires correction; and

WHEREAS, notwithstanding the provided contact information, the Department of Codes Administration is often unable to reach landlords to resolve violations; and

WHEREAS, additional landlord contact information is needed to more readily enable the Department of Codes Administration to reach hard-to-locate landlords in the event of a violation.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the members of the Metropolitan Council hereby request that the Metropolitan Department of Codes Administration revise the existing Landlord Registration Form to collect additional landlord contact information.

Section 2. That the revised form should include additional fields for “Cell Phone Number,” “Business Address,” “Best Method of Contact in an Emergency,” and other fields as the Department of Codes Administration sees fit.

Section 3. That the Metropolitan Department of Codes Administration should provide a draft of the revised Form to members of the Metropolitan Council within ninety (90) days from the date of adoption of this Resolution.

Section 4. That the Metropolitan Clerk be instructed to send a certified copy of this Resolution to the Director of the Metropolitan Department of Codes Administration upon its adoption.

Section 5. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
