RESOLUTION NO. RS2017-717

A resolution adopting new pay plans for the general employees of the Metropolitan Government of Nashville and Davidson County, excluding employees of the Board of Health, Board of Education, and the Police and Fire Departments, effective July 1, 2017, July 1, 2018, and July 1, 2019; and establishing the salaries for the Public Defender, Vice Mayor and members of the Metropolitan Council, effective upon the beginning of a new elective term of that office.

WHEREAS, the Metropolitan Civil Service Commission has, pursuant to Section 12.10 of the Metropolitan Charter, assigned each employment classification to a salary grade as of July 1, 2017, July 1, 2018, and July 1, 2019, with such assignments being equitably related to each other; and,

WHEREAS, the Civil Service Commission has adopted the salary ranges for each grade; and,

WHEREAS, the Director of Personnel for the Civil Service Commission has recommended, after the Commission’s approval, desirable salary ranges for each grade to the Director of Finance; and,

WHEREAS, pursuant to RS2016-226, a new pay plan was approved by the Metropolitan Council to go into effect on July 1, 2016; and,

WHEREAS, the pay plan that was adopted pursuant to RS2016-226 included increment pay increases that are earned at various time intervals; and,

WHEREAS, it is the desire for these increment increases to continue; and,

WHEREAS, it is further the desire that employees who are paid pursuant to open pay ranges be eligible, at the discretion of the employee’s Appointing Authority, to receive merit pay increases; and,

WHEREAS, the Civil Service Commission recognizes that the pay scales included in the pay plan adopted pursuant to RS2016-226 should be modified by applying cost of living increases as of July 1, 2017, July 1, 2018, and July 1, 2019; and,

WHEREAS, the Civil Service Commission recommends that the pay scales be increased by two (2%) percent as of July 1, 2017, by an additional three (3%) percent as of July 1, 2018, and by an additional three (3%) percent as of July 1, 2019; and,

WHEREAS, upon review it has been recommended by the Civil Service Commission that the salary for the position of Public Defender, set pursuant to RS2014-1127, should be adjusted so that it is comparable with the salary paid to the District Attorney General, which is set by the State of Tennessee; and,

WHEREAS, pursuant to § 18.05 of the Metropolitan Charter the salary of the Public Defender shall not be increased or diminished during the period for which that individual shall have been elected; and,

WHEREAS, the salary proposed by this legislation can only become effective at the beginning of a new elective term for the position of Public Defender; and,

WHEREAS, pursuant to Ordinance No. BL2013-360, the Metropolitan Department of Human Resources was directed to conduct a compensation and benefits study for the positions of Vice Mayor and members of the Metropolitan Council to determine whether and to what extent the salaries of these positions should be modified; and,

WHEREAS, the Metropolitan Department of Human Resources, with the assistance of Deloitte Consultants, LLP, conducted the study and determined the appropriate salary adjustments that should be made for these positions; and,

WHEREAS, these adjustments have been presented to and considered by the Civil Service Commission; and,

WHEREAS, the Civil Service Commission has agreed and recommended that the salary adjustments should be made; and,

WHEREAS, pursuant to § 18.05 of the Metropolitan Charter the salaries of the Vice Mayor and members of the Metropolitan Council shall not be increased or diminished during the period for which the individuals holding these offices shall have been elected; and,

WHEREAS, the salaries proposed by this legislation can only become effective at the beginning of a new elective term for the offices of Vice Mayor and members of the Metropolitan Council; and,

WHEREAS, the Director of Finance has approved all the recommendations of the Civil Service Commission and forwarded the same with a statement of full budgetary implications to the Mayor for her approval; and,

WHEREAS, the Mayor has approved the plan presented to her by the Civil Service Commission and recommends its adoption by the Metropolitan County Council.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The pay plan adopted pursuant to RS2016-226 and which went into effect on July 1, 2016, for the general employees of the Metropolitan Government, excluding employees of the Board of Health, Board of Education, and the Police and Fire Departments, from and after July 1, 2017 shall be as provided in Exhibit “A”. Exhibit “A” reflects a salary increase in the amount of two (2%) percent and the continuation of step increment adjustments. Exhibit “A” is incorporated into this Resolution as if fully set out herein.

Section 2: Additional funding shall be provided to each department in the amount of two (2%) percent of that department’s total annual open range salary budget so that employees in open range pay classifications will have the opportunity to receive merit based salary increases, at the discretion of the Appointing Authority, as reflected in Exhibit “A”. Eligibility for Open Range salary increases for FY18 will become effective as of July 1, 2017.

Section 3: The pay plan adopted to go into effect on July 1, 2017, for the general employees of the Metropolitan Government, excluding employees of the Board of Health, Board of Education, and the Police and Fire Departments, from and after July 1, 2018 shall be as provided in Exhibit “B”. Exhibit “B” reflects a salary increase in the amount of three (3%) percent and the continuation of step increment adjustments. Exhibit “B” is incorporated into this Resolution as if fully set out herein.

Section 4: Additional funding shall be provided to each department in the amount of three (3%) percent of that department’s total annual open range salary budget so that employees in open range pay classifications will have the opportunity to receive merit based salary increases, at the discretion of the Appointing Authority, as reflected in Exhibit “B”. Eligibility for Open Range salary increases for FY19 will become effective as of July 1, 2018.

Section 5: The pay plan adopted to go into effect on July 1, 2018, for the general employees of the Metropolitan Government, excluding employees of the Board of Health, Board of Education, and the Police and Fire Departments, from and after July 1, 2019 shall be as provided in Exhibit “C”. Exhibit “C” reflects a salary increase in the amount of three (3%) percent and the continuation of step increment adjustments. Exhibit “C” is incorporated into this Resolution as if fully set out herein.

Section 6: Additional funding shall be provided to each department in the amount of three (3%) percent of that department’s total annual open range salary budget so that employees in open range pay classifications will have the opportunity to receive merit based salary increases, at the discretion of the Appointing Authority, as reflected in Exhibit “C”. Eligibility for Open Range salary increases for FY20 will become effective as of July 1, 2019.

Section 7: The annual salary for the position of Public Defender shall be $166,526.00. This change in compensation, approved by this resolution, shall be effective on the first day of the next elective term for the position of Public Defender.

Section 8: The annual salary for the position of Vice Mayor shall be $25,230.00. This change in compensation, approved by this resolution, shall be effective on the first day of the next elective term for the position of Vice Mayor.

Section 9: The annual salary for the position of member of the Metropolitan Council shall be $23,100.00. This change in compensation, approved by this resolution, shall be effective on the first day of the next elective term for the position of Metropolitan Council member.

Section 10: This Resolution shall take effect on July 1, 2017, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
