ORDINANCE NO. BL2017-714

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing combination sewer main and any associated easements and to accept a new sanitary sewer manhole, fire hydrants and any associated easements, for property located at 350 22nd Avenue North, (MWS Project Nos. 16 SL-236 and 16-WL-202 and Proposal No. 2017M-036ES-001).

WHEREAS, the abandonment of approximately 68 linear feet of 10 inch combination sewer main, 243 linear feet of 15 inch combination sewer main and any associated easements, and the acceptance of a new sanitary sewer manhole, two fire hydrants and any associated easements, for property located at 350 22nd Avenue North, are needed to construct Project Nos. 16-SL-236 and 16 WL 202; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2017M-036ES-001 on April 5, 2017, for the abandonment and acceptance of said combination sewer mains, sanitary manhole, fire hydrants and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 68 linear feet of 10 inch combination sewer main, 243 linear feet of 15 inch combination sewer main and any associated easements, and to accept a new sanitary sewer manhole, two fire hydrants and any associated easements, for property located at 350 22nd Avenue North, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
