ORDINANCE NO. BL2017-729

An ordinance approving an amendment to an agreement between the Metropolitan Government and Piedmont Natural Gas Company, Inc.

WHEREAS, pursuant to ordinance BL2015-1308, the Metropolitan Council approved an agreement (the “Agreement”) between the Metropolitan Government and Piedmont Natural Gas Company, Inc. (“PNG”); and,

WHEREAS, the Agreement, among other things, authorized the conveyance to PNG of certain real property (the “Property”) belonging to the Metropolitan Government; and,

WHEREAS, the Metropolitan Government’s mulching contractor operated on the Property and was unable to remove all of the accumulated mulch within the time contemplated by the Agreement; and,

WHEREAS, pursuant to the terms of the amendment (“Amendment”) attached as Exhibit A to this ordinance, the Metropolitan Government and PNG propose to amend the Agreement to afford additional time for removal of mulch from the Property and reestablish times for closing of the sale of the Property to PNG; and;

WHEREAS, approval of the Amendment is in the best interest of the Metropolitan Government.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Amendment is approved, and the Director of Public Property or his designee is authorized to execute it on behalf of the Metropolitan Government.

Section 2. The Director of Public Property or his designee is further authorized to execute such deeds and other documents as are customary and necessary to effect the purposes of this ordinance.

Section 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
