RESOLUTION NO. RS2017-730
A resolution authorizing the Director of Public Property, or his designee, to exercise an option to purchase a portion of real property (Map 092-08-0 Parcels 103.00, 104.00 & 105.00) for the use and benefit of the Metropolitan Nashville Public Schools (Proposal No. 2017M-031PR-001).
WHEREAS, pursuant to the terms of the agreement attached hereto and incorporated herein as Exhibit A to this resolution, the Metropolitan Government holds an option to purchase three tract of approximately .05 acres located at 1715, 1717, & 1719 Jo Johnston Avenue; and,
WHEREAS, Section 2.24.250(F) of the Metropolitan Code of Laws provides:
Where land in fee simple is being purchased for purposes other than for rights-of-way for highways, streets, roads, alleys and other places for vehicular traffic, the director of public property administration shall negotiate for the purchase of such property and seek to obtain from the owner an option to sell to the Metropolitan government at a fixed price, subject to the approval of the Metropolitan Council by resolution, and no purchase shall be consummated until it has been so approved by the Metropolitan Council; and,
WHEREAS, pursuant to section 2.24.250(F) of the Metropolitan Code of Laws, the Director of Public Property Administration has negotiated an option (Exhibit A) to acquire real property located in Davidson County being Map No. 092-08-0 Parcels 103.00, 104.00.00 & 105.00 and incorporated into this resolution by reference; and,
WHEREAS, the Metropolitan Board of Education has approved the acquisition of the Property; and,
WHEREAS, it is in the best interest of the citizens of Nashville and Davidson County that the purchase of this property be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the Director of Public Property Administration, or his designee, is hereby authorized to execute the necessary documents to acquire by negotiation the property identified as Parcels 103.00, 104.00 & 105.00 on Davidson County Tax Map 092-08-0, and as described in Exhibit A.
Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1
TO
RESOLUTION NO. RS2017-730
Mr. President –
I move to amend Resolution No. RS2017-730 as follows:
I. By deleting the first recital in its entirety and substituting in lieu thereof the following:
WHEREAS, pursuant to the terms of the agreement attached hereto and incorporated herein as Exhibit A to this resolution, the Metropolitan Government holds an option to purchase three tract of approximately .05 .50 acres located at 1715, 1717, & 1719 Jo Johnston Avenue; and,
