The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Mr. Otis C. Hodges, Jr.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

RESOLUTION NO. RS2014-1317

A resolution accepting a grant from the Davidson County Mental Health and Veteran’s Court Assistance Foundation to The Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County General Sessions Court, Division II, to fund a Veteran’s Court for eligible veteran defendants for evaluations and treatment. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1318

A resolution approving an application for a Disproportionate Minority Contact Grant from the Tennessee Commission on Children and Youth to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Juvenile Court, to create an Elementary Education Service Coordinator position for elementary school students who are at risk of out of school suspension. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1319

A resolution authorizing the Director of Public Property to exercise an option to purchase property (Parcel ID No. 15800013000) for The Metropolitan Government of Nashville and Davidson County (Proposal No. 2014M-033PR-001) and the Director of Finance to accept a donation in the amount of $400,000.00 from Friends of Kellytown as a contribution towards the purchase, conservation and preservation of the property. The resolution was approved by the Planning Commission, Budget and Finance and Planning, Zoning and Historical Committees.

RESOLUTION NO. RS2014-1320

A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to provide HIV/AIDS prevention, surveillance, and sexually transmitted disease services. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2014-1321

A resolution accepting a grant from the State of Tennessee, Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, to establish programs and deliver services to prepare eligible participants for re-entry into the labor force and to offer training to those facing serious barriers to productive employment (LW09F151DSLWK15). RESOLUTION NO. RS2014-1322

A resolution accepting a grant from the State of Tennessee, Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, to establish programs and deliver services to prepare eligible participants for re-entry into the labor force (LW09F151ADULT15). RESOLUTION NO. RS2014-1323

A resolution accepting an incentive grant from the State of Tennessee, Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, to provide activities that increase the employment, retention, and earnings of participants (LW09131NCSWA14). The resolution was approved by the Budget and Finance and Personnel-Public Information-Human Resources-Housing Committees.

RESOLUTION NO. RS2014-1324

A resolution approving Amendment One to a grant from the State of Tennessee, Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, to establish programs and deliver services to prepare youth for entry into the labor force (LW09LP131YOUTH14). The resolution was approved by the Budget and Finance and Personnel-Public Information-Human Resources-Housing Committees.

RESOLUTION NO. RS2014-1325

A resolution amending an Agreement between The Metropolitan Government of Nashville and Davidson County, acting through the Metropolitan Board of Parks and Recreation, and the Tennessee Golf Foundation, approved by Ordinance No. BL99-74, regarding the privately-funded construction of golf facilities and the provision of youth-oriented instruction and programming in Shelby Park. The resolution was approved by the Budget and Finance and Parks, Library and Recreation Committees.

RESOLUTION NO. RS2014-1326

A resolution authorizing The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, to enter into Utility Easement Contract No. 8251 with the State of Tennessee, Department of Transportation, to construct PIN Number 112521.00, I-40 East to I-440 South, located in Davidson County (State Project No. 19005-1156-44 and Project No. 13-SG-0129). The resolution was approved by the Budget and Finance and Public Works Committees.

RESOLUTION NO. RS2014-1327

A resolution authorizing The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, to enter into Utility Relocation Contract No. 8250 with the State of Tennessee, Department of Transportation, to construct PIN Number 112521.00, I-40 East to I-440 South, located in Davidson County, Tennessee (State Project No. 19005-1156-44 and Project No. 13-SG-0129). The resolution was approved by the Budget and Finance and Public Works Committees.

RESOLUTION NO. RS2014-1328

A resolution approving an amendment to the contract, approved by BL2003-1365, for services by and between the United States Department of the Army and the Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, for the Mill Creek Watershed Feasibility Study in Davidson County, Tennessee, and authorizing all necessary officials to execute the same. The resolution was approved by the Budget and Finance and Public Works Committees.

RESOLUTION NO. RS2014-1329

A resolution amending Resolution No. R92-474 pertaining to the composition of the Solid Waste Region Board by reducing the number of members to reflect the dissolution of Lakewood’s city charter and maintaining an odd number of members as required by Tennessee law. The resolution was approved by the Public Works Committee.

RESOLUTION NO. RS2014-1330

A resolution establishing the requirements of the Metropolitan Government of Nashville and Davidson County by which landowners may exercise the rights established by the Vested Property Rights Act of 2014. The resolution was approved by the Planning, Zoning and Historical Committee.

RESOLUTION NO. RS2014-1331

A resolution authorizing 12 Nashville, LLC dba Music City Pizza to construct and install an aerial encroachment at 114 12th Avenue North (Proposal No. 2014M-020EN-001). The resolution was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees.

RESOLUTION NO. RS2014-1332

A resolution authorizing NGI Acquisitions, LLC, dba Skyhouse Nashville, LLC, to construct and install an aerial encroachment at 1701 Broadway (Proposal No. 2014M-021EN-001). The resolution was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees.

RESOLUTION NO. RS2014-1333

A resolution authorizing TR Church Street Corporation, dba Starbucks, to construct and install an aerial encroachment at 424 Church Street (Proposal No. 2014M-008EN-001). The resolution was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees.

RESOLUTION NO. RS2014-1334

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claims of Jason Tucker, Melissa Tucker, Larry Riley, and Diane Riley against the Metropolitan Government of Nashville and Davidson County in the amount of $600,000.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1316

A resolution appropriating one hundred thousand dollars ($100,000) from the Undesignated Fund Balance of the General Fund of the General Services District to Neighborhoods Resource Center to provide partial funding for its program services. The Budget and Finance Committee recommended deferment. In the absence of the sponsor, the resolution was deferred.

BILL NO. BL2014-990

An ordinance amending Chapter 2.212 of the Metropolitan Code to modify the eligibility requirements for obtaining small business economic development incentive grants. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.

BILL NO. BL2014-991

An ordinance amending Chapter 4.20 of the Metropolitan Code pertaining to minimum wage and payroll information retention and inspection, and to assure protection of private information. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Personnel-Public Information-Human Resources-Housing Committees by a voice vote of the Council.

BILL NO. BL2014-992

An ordinance amending Section 16.44.030 of the Metropolitan Code pertaining to noise from construction sites. Upon motion duly seconded, the bill passed first reading and was referred to the Codes, Fair and Farmers Market Committee by a voice vote of the Council.

BILL NO. BL2014-993

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to regulate low speed vehicles within certain portions of Nashville and Davidson County, and to amend Title 6 of the Metropolitan Code to provide for such regulations.
Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Convention, Tourism and Public Entertainment Facilities, Public Works and Traffic, Parking and Transportation Committees by a voice vote of the Council.

BILL NO. BL2014-994

An ordinance authorizing Amendment Number One (1) to the Division Street Extension Phase 1 Right-of-Way Acquisition, for additional acquisition of certain right-of-way, slope and temporary construction easements and property rights between 4th Avenue South and 8th Avenue South, and including Fogg Street and 7th Avenue South, for the closure of the CSXT crossing for use by the Metropolitan Government (Proposal No. 2013M-041PR-002). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2014-995

An ordinance authorizing the acquisition by negotiation or condemnation of temporary and permanent utility easements relating to the installation of a new eight inch water main along Brandau Road and Hoggett Ford Road, approving the form of a participation financing agreement for property owners to connect to the new water main, and amending Chapter 15.52 of the Metropolitan Code to allow for the construction and financing arrangement set forth herein (Proposal No. 2015M-001ES-001). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Budget and Finance, Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2014-996

An ordinance adopting the Geographic Information Systems Street and Alley Centerline Layer as the official street and alley acceptance and maintenance record for the Metropolitan Government of Nashville and Davidson County and amending Title 13 of Metropolitan Code of Law to incorporate same. The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.

With one objection, the rules were suspended for consideration of one (1) late bill.

BILL NO. BL2014-997

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon easement rights that were previously retained by Council Bill No. BL 2007-104 within a portion of the former Alley #236 for properties located at 1701 and 1707 Broadway, and 115 17th Avenue South, (Proposal No. 2014M-074ES-001). The bill was approved by the Planning Commission. Ms. Gilmore moved to pass the bill on first reading and refer it to the Public Works and Planning, Zoning and Historical Committees which motion was seconded and adopted by a voice vote of the Council.

An ordinance authorizing the Director of Public Property to accept and record an easement in favor of the Metropolitan Government on certain parcels of property for use in the Gulch Greenway systems (Proposal No. 2014M-075ES-001). The bill was approved by the Planning Commission, Parks, Library and Recreation and Planning, Zoning and Historical Committees. Ms. Gilmore moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon easement rights that were previously retained by Council Bill No. BL2003-1518 within a portion of the former right of way of Harcome Avenue for properties located at 1127A and 1127B Belvidere Drive (Proposal No. 2014M-059ES-001). The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. Mr. Anthony Davis moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-965

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the Whites Creek Pike Stormwater Improvement Project for 13 properties located along Whites Creek Pike, Moormans Arm Road, and Malta Drive (Project No. 13-SWC-154 and Proposal No. 2014M-073ES-001). The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. Mr. Harrison moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-966

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon retained easement rights that were previously retained by Council Ordinance 74-1115 within a portion of the former right of way of 50th Avenue North on property located at 4910 Indiana Avenue (Proposal No. 2014M-051ES-001). The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. Mr. Baker moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-967

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 560 linear feet of existing six inch public water main and to accept approximately 293 linear feet of eight inch public water main along with one fire hydrant assembly, 311 feet of 10” public sewer main, and two new manholes for properties located at 2400 Charlotte Avenue and 407 23rd Avenue North (MWS Project Nos. 14-Sl-52 and 14-WL-50 and Proposal No. 2014M-053ES-001). The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. BILL NO. BL2014-968

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 50 linear feet of existing eight inch public sewer main and a 50 foot prescriptive easement and to accept two sewer manholes for properties located at 5519 Kentucky Avenue and Kentucky Avenue (unnumbered) (MWS Project No. 14-SL-78 and Proposal No. 2014M-054ES-001). The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the Westwood Stormwater Improvement Project for eight properties located at 2106 and 2108 Woodlawn Drive and 2117, 2119, 2121, 2123, 2124, and 2125 Westwood Avenue (Project No. 15-SWC-018 and Proposal No. 2014M-069ES-001). The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. BILL NO. BL2014-974

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the Terragon Trail Stormwater Improvement Project for three properties located at 4820, 4821, and 4825 Terragon Trail (Project No. 15-SWC-029 and Proposal No. 2014M-068ES-001). The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. Mr. Dominy moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-975

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 10 linear feet of existing eight inch public sewer main along with approximately 10 feet of the existing easement and to accept one new public sewer manhole and two public fire hydrants for properties located at 725 and 731 Melpark Drive, 2350 Franklin Pike, and 700 Craighead Street (MWS Project Nos. 14-WL-88 and 14-SL-104, Proposal No. 2014M-070ES-001).
