ORDINANCE NO. BL2014-968

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 50 linear feet of existing eight inch public sewer main and a 50 foot prescriptive easement and to accept two sewer manholes for properties located at 5519 Kentucky Avenue and Kentucky Avenue (unnumbered) (MWS Project No. 14-SL-78 and Proposal No. 2014M-054ES-001).

WHEREAS, the abandonment of approximately 50 linear feet of existing eight inch public sewer main and a 50 foot prescriptive easement and the acceptance of two sewer manholes for properties located at 5519 Kentucky Avenue and at Kentucky Avenue (unnumbered) are needed to construct MWS project number 14-SL-78; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2014M-054ES-001 on September 23, 2014, for the abandonment of said easements and the acceptance of said sewer manholes.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 50 linear feet of existing eight inch public sewer main and a 50 foot prescriptive easement and to accept two sewer manholes for properties located at 5519 Kentucky Avenue and at Kentucky Avenue (unnumbered), as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
