ORDINANCE NO. BL2014-980

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon and relocate 582 linear feet of 10 inch DIP sewer force main and also 398 linear feet of 10 inch DIP sewer force main; to accept 1153 linear feet of eight inch DIP water main, 655 linear feet of six inch DIP water main and two fire hydrant assemblies; and to accept 335 linear feet of 10 inch DIP sanitary sewer, 170 linear feet of 10 inch PVC sanitary sewer, 782 linear feet of eight inch DIP sanitary sewer, and 375 linear feet of eight inch PVC sanitary sewer for a portion of properties located along Dodson Chapel Road (unnumbered) and Hoggett Ford Road (unnumbered) (MWS Project Nos. 14-WL-67 and 14-SL-79 and Proposal No. 2014M-072ES-001).

WHEREAS, the abandonment and relocation of 582 linear feet of 10 inch DIP sewer force main and also 398 linear feet of 10 inch DIP sewer force main; the acceptance of 1153 linear feet of eight inch DIP water main, 655 linear feet of six inch DIP water main and two fire hydrant assemblies; and the acceptance of 335 linear feet of 10 inch DIP sanitary sewer, 170 linear feet of 10 inch PVC sanitary sewer, 782 linear feet of eight inch DIP sanitary sewer, and 375 linear feet of eight inch PVC sanitary sewer for a portion of properties located along Dodson Chapel Road (unnumbered) and Hoggett Ford Road (unnumbered) are needed to construct MWS project numbers 14-WL-67 and 14-SL-79; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2014M-072ES-001 on October 23, 2014, for the abandonment, relocation, and acceptance of said sewer and water mains and fire hydrant assemblies.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon and relocate 582 linear feet of 10 inch DIP sewer force main and also 398 linear feet of 10 inch DIP sewer force main; to accept 1153 linear feet of eight inch DIP water main, 655 linear feet of six inch DIP water main and two fire hydrant assemblies; and to accept 335 linear feet of 10 inch DIP sanitary sewer, 170 linear feet of 10 inch PVC sanitary sewer, 782 linear feet of eight inch DIP sanitary sewer, and 375 linear feet of eight inch PVC sanitary sewer for a portion of properties located along Dodson Chapel Road (unnumbered) and Hoggett Ford Road (unnumbered), as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment, relocation, and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
