ORDINANCE NO. BL2014-959

An ordinance authorizing the Director of Public Property Administration, or his designee, to accept, execute and record a quitclaim deed from the Friends of The Warner Parks, Inc., to The Metropolitan Government of Nashville and Davidson County for a certain parcel of property located on Highway 100 for use as part of the public park system but excluding a 5.01 acre tract and granting an easement for ingress and egress across said tract (Proposal No. 2014M-028PR-00).

WHEREAS, pursuant to the terms of the quitclaim deed attached as Exhibit 1 to this Ordinance, the Friends of The Warner Parks, Inc., has agreed to donate to the Metropolitan Government of Nashville and Davidson County all the interest it may possess in the real property (the “Property”), more particularly described in Exhibit A to the quitclaim deed for use as part of the public park system; and,

WHEREAS, the donation excludes a 5.01 acre tract, more particularly described in Exhibit B to the quitclaim deed, and grants an easement (the “Easement”) of ingress and egress on said tract; and,

WHEREAS, the Board of Parks and Recreation approved the acceptance of this donation at its meeting July 7, 2009; and,

WHEREAS, the citizens of Nashville and Davidson County will benefit by accepting the Property.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Director of Public Property, or his designee, is authorized to accept, execute and record a quitclaim deed, attached as Exhibit 1 to this Ordinance, from the Friends of The Warner Parks, Inc., to The Metropolitan Government of Nashville and Davidson County for a certain parcel of property located on Highway 100, more particularly described in Exhibit A to the quitclaim deed, but excluding a 5.01 acre tract, more particularly described in Exhibit B to the quitclaim deed, and granting an easement for ingress and egress across said tract.

Section 2. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
