ORDINANCE NO. BL2014-977

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to acquire permanent easements through negotiations, condemnation, or fee simple take for the Davidson and Brook Hollow Sewer Line Improvement Project for properties located at 612 and 622 Davidson Drive and at 615, 619, 623 and 627 Georgetown Drive (MWS Project No. 11-SC-0143 and Proposal No. 2014M-058ES-001).

WHEREAS, the negotiations, condemnation or fee simple take of permanent easements for properties located at 612 and 622 Davidson Drive and at 615, 619, 623 and 627 Georgetown Drive, are needed to construct the Davidson and Brook Hollow Sewer Line Improvement Project No. 11-SC-0143; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2014M-058ES-001 on September 29, 2014, for the negotiation, condemnation, or fee simple take of permanent easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to negotiate, condemn, or fee simple take permanent easements for properties located at 612 and 622 Davidson Drive and at 615, 619, 623 and 627 Georgetown Drive, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the negotiations, condemnation, or fee simple take authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
