ORDINANCE NO. BL2014-979

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate, condemn, or fee simple take permanent and temporary drainage easements for the proposed alignment of approximately 1,000 linear feet of eight inch water main and pressure reducing valve (PRV) for seven properties located at 20 and 22 Inveraray Drive, 30 and 31 Hillcrest Heights Drive, 4400 and 4405 Carlton Court, and 3 Kenilworth Drive (Project No. 14-WG-0111 and Proposal No. 2014M-071ES-001).

WHEREAS, the negotiations, condemnation or fee simple take of permanent and temporary drainage easements for the proposed alignment of approximately 1,000 linear feet of eight inch water main and pressure reducing valve (PRV) for seven properties located at 20 and 22 Inveraray Drive, 30 and 31 Hillcrest Heights Drive, 4400 and 4405 Carlton Court, and 3 Kenilworth Drive, are needed to construct the Northumberland Sewer and Water Improvement Project No. 14-WG-0111; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2014M-071ES-001 on October 27, 2014, for the negotiations, condemnation or fee simple take of said permanent and temporary drainage easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to negotiate, condemn, or fee simple take permanent and temporary drainage easements for the proposed alignment of approximately 1,000 linear feet of eight inch water main and pressure reducing valve (PRV) for seven properties located at 20 and 22 Inveraray Drive, 30 and 31 Hillcrest Heights Drive, 4400 and 4405 Carlton Court, and 3 Kenilworth Drive, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the negotiations, condemnation, or fee simple take authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
