RESOLUTION NO. RS2014-1328

A resolution approving an amendment to the contract, approved by BL2003-1365, for services by and between the United States Department of the Army and the Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, for the Mill Creek Watershed Feasibility Study in Davidson County, Tennessee, and authorizing all necessary officials to execute the same.

WHEREAS, The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, previously entered into a contract for the Mill Creek Watershed Feasibility Study with the United States Department of the Army, as approved by Council in BL2003-1365; and,

WHEREAS, the original agreement with the United States Department of the Army requires that Metro consent any time the original scope is modified; and,

WHEREAS, due to an increase in the cost of finalizing the Feasibility phase of study and finalizing the Feasibility Report to include all final reviews, there will be additional Study Costs; and,

WHEREAS, the Metropolitan Government of Nashville and Davidson County’s portion of the estimated increased cost will be a work in-kind contribution of $125,000.00 to match $125,000.00 in existing United States Department of the Army funds for a total of $250,000.00; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that such amendment be accepted.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the amendment to the agreement between the United States Department of the Army and The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, to conduct a feasibility study of the Mill Creek Watershed, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
