RESOLUTION NO. RS2014-1325

A Resolution amending an Agreement between The Metropolitan Government of Nashville and Davidson County, acting through the Metropolitan Board of Parks and Recreation, and the Tennessee Golf Foundation, approved by Ordinance No. BL99-74, regarding the privately-funded construction of golf facilities and the provision of youth-oriented instruction and programming in Shelby Park.

WHEREAS, Ordinance BL99-74 approved an Agreement between the Metropolitan Government of Nashville and Davidson County and the Tennessee Golf Foundation (“TGF”); and,

WHEREAS, the Agreement authorized the privately-funded construction of golf facilities and the provision of youth-oriented instruction and programming in Shelby Park; and,

WHEREAS, the parties desire to amend the Agreement to extend its term and address certain operations and revenue matters; and,

WHEREAS, Ordinance No. BL99-74 requires that any amendment, renewal, or extension of the terms of the Agreement must be approved by Resolution of the Metropolitan Council; and,

WHEREAS, it is in the interest of the citizens of The Metropolitan Government of Nashville and Davidson County that this Amendment to the Agreement approved by Ordinance No. BL99-74 be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Amendment number 1 to the Agreement between the Metropolitan Government of Nashville and Davidson County and the Tennessee Golf Foundation, approved by Ordinance BL99-74 and attached hereto, is hereby approved.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
