ORDINANCE NO. BL2014-996

An ordinance adopting the Geographic Information Systems Street and Alley Centerline Layer as the official street and alley acceptance and maintenance record for The Metropolitan Government of Nashville and Davidson County and amending Title 13 of Metropolitan Code of Law to incorporate same.

WHEREAS, Metropolitan Code of law 13.08.010 created and established the Official Street and Alley Acceptance and Maintenance Map for the Metropolitan Government of Nashville and Davidson County, said map being composed of a series of Atlas Sheet Base Maps showing the dedicated streets and alleys which were either accepted or abandoned for Public maintenance by the Metropolitan Government, and the process by which to amend said map; and,

WHEREAS, pursuant to Metropolitan Code of Law 13.08.010, the Official Street and Alley Acceptance and Maintenance Map is on file in the office of the Department of Public Works and the Director of Public Works is authorized to note any amendatory ordinance enacted by the Metropolitan Council; and,

WHEREAS, the Geographic Information Systems Street and Alley Centerline, is a file that integrates, stores, edits, analyzes, shares, and displays geographic information, namely right-of-way; and,

WHEREAS, the Geographic Information Systems Street and Alley Centerline has been edited to show the dedicated streets and alleys which were accepted or abandoned for Public maintenance by the Metropolitan Government; and,

WHEREAS, the Geographic Information Systems Street and Alley Centerline Layer is maintained by Public Works; and,

WHEREAS, due to the ease of use, including updating and production for public dissemination,
it is deemed to be the best interest of the Metropolitan Government to make all further amendments and edits to the Geographic Information Systems Street and Alley Centerline and to adopt the Geographic Information Systems Street and Alley Centerline as the official street and alley acceptance and maintenance record for the Metropolitan Government of Nashville and Davidson County.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Geographic Information Systems Street and Alley Centerline Layer is adopted as the official street and alley acceptance and maintenance record for The Metropolitan Government of Nashville and Davidson County.

Section 2. The Title of Section 13.08.10 be amended by deleting the word “map” and substituting in lieu thereof the word “record.”

Section 3. Title 13, Section 13.08.010, Subsection A be amended by deleting it in its entirety and replacing it with the following:

“There is created and established an official street and alley acceptance and maintenance record for the metropolitan government, which record is composed of a series of maps showing thereon, by words, lines or symbols, the dedicated streets and alleys which are accepted and maintained or abandoned for public maintenance by the metropolitan government. The official street and alley acceptance record herein established may be amended from time to time by ordinance of the metropolitan council setting out additions, deletions or any other amendments to such record.

Section. 4. Title 13, Section 13.08.010, Subsection B be amended by deleting the word “map” and substituting in lieu thereof the word “record.”

Section. 5. Title 13, Section 13.08.010, Subsection C be amended by deleting the word “map” and substituting in lieu thereof the word “record” and by deleting the words “a fee of one hundred dollars to cover the cost of processing such application or request” and substituting in lieu thereof “a fee to cover the cost of processing such application or request as established by the Metropolitan Council.”

Section 6. This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
