ORDINANCE NO. BL2014-975

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 10 linear feet of existing eight inch public sewer main along with approximately 10 feet of the existing easement and to accept one new public sewer manhole and two public fire hydrants for properties located at 725 and 731 Melpark Drive, 2350 Franklin Pike, and 700 Craighead Street (MWS Project Nos. 14-WL-88 and 14-SL-104, Proposal No. 2014M-070ES-001).

WHEREAS, the abandonment of approximately 10 linear feet of existing eight inch public sewer main along with approximately 10 feet of the existing easement and the acceptance of one new public sewer manhole and two public fire hydrants for properties located at 725 and 731 Melpark Drive, 2350 Franklin Pike, and 700 Craighead Street are needed to construct MWS Project Nos. 14-WL-88 and 14-SL-104; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2014M-070ES-001 on October 16, 2014, for the abandonment and acceptance of said sewer main and easement, public sewer manhole, and public fire hydrants.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to approximately 10 linear feet of existing eight inch public sewer main along with approximately 10 feet of the existing easement and to accept one new public sewer manhole and two public fire hydrants for properties located at 725 and 731 Melpark Drive, 2350 Franklin Pike, and 700 Craighead Street, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
