ORDINANCE NO. BL2014-973

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the Westwood Stormwater Improvement Project for eight properties located at 2106 and 2108 Woodlawn Drive and 2117, 2119, 2121, 2123, 2124, and 2125 Westwood Avenue (Project No. 15-SWC-018 and Proposal No. 2014M-069ES-001).

WHEREAS, the negotiation and acceptance of permanent and temporary easements for eight properties located at 2106 and 2108 Woodlawn Drive and 2117, 2119, 2121, 2123, 2124, and 2125 Westwood Avenue are needed to construct MWS Project 15-SWC-018; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2014M-069ES-001 on October 15, 2014 for the negotiation and acceptance of permanent and temporary easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to negotiate and accept permanent and temporary easements for eight properties located at 2106 and 2108 Woodlawn Drive and 2117, 2119, 2121, 2123, 2124, and 2125 Westwood Avenue as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the negotiations and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
