ORDINANCE NO. BL2014-965

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the Whites Creek Pike Stormwater Improvement Project for 13 properties located along Whites Creek Pike, Moormans Arm Road, and Malta Drive, (Project No. 13-SWC-154 and Proposal No. 2014M-073ES-001).

WHEREAS, the negotiation and acceptance of permanent and temporary easements for 13 properties located along Whites Creek Pike, Moormans Arm Road, and Malta Drive, are needed to construct the Whites Creek Pike Stormwater Improvement Project, MWS Project 13-SWC-154; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2014M-073ES-001 on October 27, 2014, for the negotiation and acceptance of permanent and temporary easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to negotiate and accept permanent and temporary easements for the Whites Creek Pike Stormwater Improvement Project for 13 properties located along Whites Creek Pike, Moormans Arm Road, and Malta Drive, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the negotiation and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
