RESOLUTION NO. RS2014-1319

A resolution authorizing the Director of Public Property to exercise an option to purchase property (Parcel ID No. 15800013000) for The Metropolitan Government of Nashville and Davidson County (Proposal No. 2014M-033PR-001) and the Director of Finance to accept a donation in the amount of $400,000.00 from Friends of Kellytown as a contribution towards the purchase, conservation and preservation of the property.

WHEREAS, Regency Realty Group, Inc. (“Regency”) owns a tract of property (Parcel ID No. 15800013000; the “Kellytown Property”) of approximately 6.72 acres located at the southeast corner of Hillsboro Road and Old Hickory Boulevard in Davidson County; and,

WHEREAS, Native American remains and artifacts have been found on the Kellytown Property, and acquisition by the Metropolitan Government would best permit preservation of the Kellytown Property’s unique archeological and historical characteristics; and,

WHEREAS, Metropolitan Code of Laws § 2.24.250(F) provides that fixed-price options for the purchase of fee-simple interest in real property to be used for certain purposes may be approved by resolution of the Metropolitan Council; and,

WHEREAS, pursuant to the terms of the option agreement (the “Option”) attached as Exhibit 1 and incorporated into this resolution by reference, Regency proposes to sell the Kellytown Property to the Metropolitan Government; and,

WHEREAS, as described in the letter attached to this resolution as Exhibit 2, Friends of Kellytown propose to donate $400,000.00 (the “Donation”) to the Metropolitan Government as a contribution towards the purchase, conservation and preservation of the Kellytown Property; and,

WHEREAS, purchase of the Kellytown Property and acceptance of the Donation is in the best interest of the citizens of the Metropolitan Government.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

Section 1. That the Director of Public Property Administration is hereby authorized to exercise the Option and to receive, execute and record such documents as may be necessary to carry out the purchase of the Kellytown Property.

Section 2. That the Director of Finance is authorized to accept the Donation for use in the purchase, conservation and preservation of the Kellytown Property.

Section 3. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
