RESOLUTION NO. RS2014-1329

A resolution amending Resolution No. R92-474 pertaining to the composition of the Solid Waste Region Board by reducing the number of members to reflect the dissolution of Lakewood’s city charter and maintaining an odd number of members as required by Tennessee law.

WHEREAS, Resolution No. R92-474 established, pursuant to T.C.A. § 68-211-813(b)(1), a Municipal Solid Waste Region Board, said board being composed of thirteen (13) board members, eight (8) of which are appointed by the Metropolitan Mayor of Nashville and Davidson County and approved by the Metropolitan Council, one (1) board member appointed by the mayor of the satellite city of Belle Meade, one (1) board member appointed by the mayor of the satellite city of Oak Hill, one (1) board member appointed by the mayor of the satellite city of Goodlettsville, one (1) member appointed by the mayor of the satellite city of Berry Hill and one (1) board member appointed by the mayor of the satellite city of Lakewood; and,

WHEREAS, pursuant to T.C.A. § 68-211-813(b)(1), the board shall consist of an odd number of members; and,

WHEREAS, by referendum held March 15, 2011, the voters of the City of Lakewood approved the surrender of the city charter.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Resolution No. R92-474, Section 5, is amended by deleting the word “eight” and number “8” and substituting in lieu thereof the word “seven” and the number “7”, and by deleting in its entirety the following language:

“; and due to the fact that the satellite city of Lakewood collects or provides disposal services through its own initiative or by contract, the city of Lakewood shall have one (1) board member appointed by the Mayor of Lakewood and approved by the legislative body thereof.”

Section 2. That Resolution No. R92-474 is amended by deleting Section 9 in its entirety and substituting with the following:

SECTION 9. That the Municipal Solid Waste Region Board, in furtherance of its duties, is authorized to apply for and receive funds from the State of Tennessee; the federal government; The Metropolitan Government of Nashville and Davidson County; the cities of Belle Meade, Berry Hill, Oak Hill, and Goodlettsville; and donations and grants from private corporations and foundations.

Section 3. This Resolution shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
