Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Reverend Janet Watson of the Jefferson Street Baptist Church.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

Metropolitan Nashville Airport Authority

Appointment of Mr. Irby Simpkins to the Metropolitan Nashville Airport Authority. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Mr. Waters moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Alarm Appeals Board

Appointment of Mr. Jamie Isabel to the Alarm Appeals Board. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Mr. Waters moved for confirmation, which motion was seconded and adopted by a roll call vote of the Council.

Metropolitan Nashville Arts Commission

Appointment of Ms. Barbara Chazen and Mr. Jon Glassmeyer to the Metropolitan Nashville Arts Commission. The Rules-Confirmations-Public Elections Committee recommended the appointments, and Mr. Waters moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Metropolitan Board of Health

Appointment of Dr. Henry Foster to the Metropolitan Board of Health. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Mr. Waters moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Historic Zoning Commission

Appointment of Mr. Stewart Clifton to the Historic Zoning Commission. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Mr. Waters moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Municipal Solid Waste Region Board

Appointment of Mr. Cliff Russell to the Municipal Solid Waste Region Board. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Mr. Waters moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Sexually Oriented Business Licensing Board

Appointment of Mr. Johnny Crumby to the Sexually Oriented Business Licensing Board. The Rules-Confirmations-Public Elections Committee recommended indefinite deferment of the appointment. Mr. Waters moved for indefinite deferment, which motion was seconded and adopted by a unanimous vote of the Council.

Vegetation Control Board

Reappointment of Mr. Hollis Malone to the Vegetation Control Board. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Mr. Waters moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

The President called for nomination to fill one vacancy on the Industrial Development Board of The Metropolitan Government of Nashville and Davidson County for an unexpired term ending October 7, 2003. Mr. Summers nominated Mr. Nicholas D. Bailey, which nomination was seconded. There being no further nominations, the matter was referred to the Rules-Confirmations-Public Elections Committee for a recommendation and an election will be conducted at the next regular meeting of the Council.

RESOLUTION NO. RS99-85

A resolution appropriating the amount of $7,272,375 from the General Fund Reserve Fund for the purchase of equipment and for making repairs to buildings for various departments of The Metropolitan Government of Nashville and Davidson County. The resolution was approved by the Budget and Finance; Codes, Fair and Farmers Market; Education; Health, Hospitals and Social Services; Parks, Library, Recreation and Auditorium; Personnel-Public Information-Human Relations-Housing; Public Safety-Beer, Wine and Whiskey; Public Works; Rules-Confirmations-Public Elections and Planning, Zoning and Historical Committees. Mr. Majors offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. A resolution amending the 1999-2000 to 2004-2005 Capital Improvements Budget (Ordinance No. 099-1675) to modify several Department of Water Services projects (Project No. 99WC0001 Water Infrastructure Rehabilitation; Project No. 98WG0011 Cane Ridge-Brentwood Water Service Improvements- Construct; Project No. 97WC0001 Cumberland 24" Water Main-construct; and Project No. 98WG0010 Joelton Water Improvements-construct). The bill was approved by the Planning Commission, Budget and Finance, Public Works and Planning, Zoning and Historical Committees. BILL NO. BL2000-140

An ordinance approving the acceptance of a law enforcement block grant from the U.S. Department of Justice to The Metropolitan Government of Nashville and Davidson County, acting through the Metropolitan Department of Police for the benefit the Department of Police, the Office of the District Attorney General, the Sheriff’s Office, Metropolitan Public Schools, Criminal Court, Juvenile Court, Public Defender, the Justice Information Systems, and the Council of Community Services, and approving matching funds thereof. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Public Safety-Beer, Wine and Whiskey and Education Committees by a voice vote of the Council.

An ordinance approving a grant in the amount of $20,000.00 to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation, for the urban and community forestry grant assistance program. An ordinance approving a lease agreement between The Metropolitan Government of Nashville and Davidson County and Forensic Medical Management Services, P.C., to provide out-of-county autopsies to the State of Tennessee. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Health, Hospitals and Social Services Committees by a voice vote of the Council.

BILL NO. BL2000-143

An ordinance authorizing the acquisition of property by negotiation or condemnation for use in a public project for The Metropolitan Government of Nashville and Davidson County and specifically with relation to the construction of additions to Head Middle School. The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Education and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2000-144

An ordinance authorizing Level 3 Communications, LLC to construct, install, and maintain a fiber optic cable along Nolensville Pike, Franklin Road, Harding Place, and Old Hickory Boulevard, (Proposal No. 2000M-001G-00), all of which is more particularly described herein. The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2000-145

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IR District to MUL District properties at 415 Chestnut Street and 4th Avenue South (unnumbered), abutting the north margin of the CSX Railroad (1.75 acres), (Proposal No. 99Z-151U-11), all of which is more particularly described herein. The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.

Without objection the rules were suspended for consideration of one (1) late bill.

An ordinance accepting certain right-of-way from Gateway Southeast Properties, Inc., for a relocated drainage easement and abandoning certain right-of-way across existing drainage easement to Gateway Southeast Properties, Inc. Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from SCC District to CS District property at 2960 Old Hickory Boulevard, approximately 620 feet south of Highway 70 South (3.59 acres), (Proposal No. 99Z-166G-06), all of which is more particularly described herein. The bill was disapproved by the Planning Commission and approved by the Planning, Zoning and Historical Committee. Mr. Lineweaver filed two letters for the record. Mr. Lineweaver moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL99-105

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending a portion of the preliminary site plan of the Commercial (General) Planned Unit Development District located abutting the southeast margin of Memphis-Bristol Highway and Old Hickory Boulevard, classified SCC (3.59 acres), to permit a 74,588 square foot self-service storage facility, replacing a 29,340 square foot office building, (Proposal No. 61-84-G-06), all of which is more particularly described herein. The bill was disapproved by the Planning Commission and approved by the Planning, Zoning and Historical Committee. Mr. Lineweaver filed two letters for the record. Mr. Lineweaver moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.
