ORDINANCE NO. BL2000-137

An ordinance authorizing Old Hickory Hills, LLC, to pay the Metropolitan Government, Department of Water and Sewerage Services, $300,000 for operation and maintenance costs of the Old Hickory Hills Pumping Station and Force Main for their life, Project No. 99-SL-142.

WHEREAS, Old Hickory Hills, LLC, has expressed a desire to extend a public pressure sewer system to serve Old Hickory Hills Subdivision, Project No. 99-SL-142; and

WHEREAS, it is deemed in the best interest of the public to accept the costs of operating and maintaining the pumping station and force main to make sewerage service available to 412 units in the Turkey Creek Basin of Davidson County; and

WHEREAS, this project is identified in Metro’s 1999-2000 Capital Improvements Budget as Project No. 96-SG-0001.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government is hereby authorized to accept from Old Hickory Hills, LLC, an amount of $300,000.00 for the operation and maintenance costs of the pumping station and force main designated as Project No. 99-SL-142 and more specifically defined in the Participation Agreement, a copy attached.

SECTION 2: That this ordinance shall take effect after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
