ORDINANCE NO. BL99-122

An ordinance abandoning the water line and easement on Map 72-15 (Proposal No. 99M-134U-05) retained in Ordinance 098-1269 of the proposed Project No. 99-WG-120, Pennington Avenue Easement Abandonment wherein a portion of Pennington Avenue was closed, and authorizing the Metropolitan Mayor to execute the attached document.

WHEREAS, Bridgewood Park Limited Partnership is the owner of real property encumbered by a water easement; and,

WHEREAS, Bridgewood Park Limited Partnership has installed a new water line which adequately serves the lots and the neighboring properties; and,

WHEREAS, the water easement is no longer being used by the Department of Water and Sewerage Services, more particularly described on the plans for Project No. 99-WG-120, Pennington Avenue Easement Abandonment, on record in the office of the Director of Water and Sewerage Services, said plans are made a part hereof as though copied herein; and,

WHEREAS, the Department of Water and Sewerage Services has no need for the said portion of easements; and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has already approved the abandonment of said portion of easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the water line and the water easement shown on Map 72-15, Parcel 232, is declared abandoned, and the Metropolitan Mayor is hereby authorized to execute the appropriate instruments to carry out such abandonment.

SECTION 2: That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
