ORDINANCE NO. BL2000-131

An ordinance abandoning the sewer line and easement oil Map 118-11, Parcel 61 (Proposal No. 99M-139U- 11), of the proposed Project No. 99-SL-111 Berry Hill City Hall Easement Abandonment, and authorizing the Metropolitan Mayor to execute the attached document.

WHEREAS, City of Berry Hill is the owner of real property encumbered by a sewer easement, and,

WHEREAS, City of Berry Hill has relocated a tire hydrant and sewer line which adequately serves the lot and the neighboring properties; and,

WHEREAS, the sewer easement is no longer being used by the Department of Water and Sewerage Services, more particularly described on the plans for Project No. 99-SL-111, Berry Hill City Hall Easement Abandonment, on record in the office of the Director of Water and Sewerage Services, said plans are made a part hereof as though copied herein; and,

WHEREAS, the Department of Water and Sewerage Services has no need for the said easement and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has already approved the abandonment of said easement.

NOW, THEREFORE, BE THE ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the sewer line and sewer easement shown on Map 118-11, Parcel 161, is declared abandoned, and the Metropolitan Mayor is hereby authorized to execute the appropriate instruments to carry out such abandonment.

SECTION 2: That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
