ORDINANCE NO. BL2000-146

An ordinance accepting certain right-of-way from Gateway Southeast Properties, Inc. for a relocated drainage easement and abandoning certain right -of-way across existing drainage easement to Gateway Southeast Properties, Inc.

Whereas, The Metropolitan Government of Nashville and Davidson County (the "Metropolitan Government") desires to relinquish any interest it may have in a certain stormwater drainage easement located in Nashville, Tennessee, and more particularly identified on Exhibit A attached hereto, to Gateway Southeast Properties, Inc. a California corporation ("Gateway"); and

Whereas, Gateway desires to dedicate and convey to The Metropolitan Government of Nashville and Davidson County certain right-of-way for a relocated drainage easement as described in Exhibit B;

Now therefore, be it enacted by the Council of the Metropolitan Government of Nashville and Davidson County:

Section 1.  (a) The Metropolitan Government hereby relinquishes to Gateway of its right, title and interest in and to the drainage easement area described on the map attached hereto as Exhibit A and incorporated herein upon receipt of appropriate instrument dedicating the easement as described in paragraph (b) herein.

(b)  The area indicated and described on the map attached hereto as Exhibit B and incorporated herein, having been dedicated by Gateway to the Metropolitan Government, is accepted by the Metropolitan Government as an easement for stormwater drainage purposes.

Section 2: This ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

TO

ORDINANCE NO. BL2000-146

Mr. President:

I move to amend Ordinance No. BL2000-146 by adding the following sentence to Section 1(a) thereof:

"Said instrument shall include evidence satisfactory to the Director of Public Works that the terms and conditions of the document attached hereto as Exhibit 1 have been fully satisfied."
