ORDINANCE NO. BL2000-130

An ordinance abandoning the sewer line, water line and easements on Map 105-6, Parcels 311 and 348, retained in Ordinance 060-106 of the old City of Nashville, and Ordinances 072-401 and 081-748 as indicated on the proposed Project No. 99-SG-143, Hamilton/Southgate Avenue Area Easement Abandonment, and authorizing the Metropolitan Mayor to execute the attached document.

WHEREAS, Norwall Company is the owner of real property encumbered by sewer and water lines and easements; and,

WHEREAS, Norwall Company has installed new lines which adequately serves the lots;

WHEREAS, the sewer and water lines and easements are no longer being used by the Department of Water and Sewerage Services, more particularly described on the plans for Project No. 99-SG-143, Hamilton/Southgate Avenues Area Easement Abandonment, on record in the office of the Director of Water and Sewerage Services, said plans are made a part hereof as though copied herein; and,

WHEREAS, the Department of Water and Sewerage Services has no need for the said sewer and water lines and easements; and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has already approved the abandonment of said easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the sewer and water lines and easements shown on Map 105-6, Parcels 311 and 348, are declared abandoned, and the Metropolitan Mayor is hereby authorized to execute the appropriate instruments to carry out such abandonment.

SECTION 2: That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Mr. President:

I move to amend Ordinance No. BL2000-130 by substituting the amended drawing (see attached) to correctly depict the location of the easements to be abandoned.
