The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.
The invocation was offered by Terrence Gibson of Cross Point Church.
The Metropolitan Council gave the pledge of allegiance to the American Flag.

- ELECTIONS AND CONFIRMATIONS –
Electrical Examiners and Appeals Board
Reappointment of Mr. Robert Cohen for a term expiring April 15, 2021. The Rules, Confirmations, and Public Elections Committee recommended the reappointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
Emergency Communications District Board
Reappointment of Mr. David Gleason for a term expiring February 14, 2021. The Rules, Confirmations, and Public Elections Committee recommended the reappointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
Plumbing Examiners and Appeals Board
Appointment of Mr. Tommy Krantz for a term expiring March 10, 2018. Mr. Krantz will fill the unexpired term of Mr. Carl Krantz. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
General Sessions Court Judge
The President called for an election to fill a vacancy in the office of General Session Judge Division X. Nominations previously made were: Michael Clemons; Sam Coleman; Adam Dread; Ana Escobar; Barry Gearon, Jr., Martesha Johnson; Nick McGregor; Tillman Payne III. Mr. Dread and Mr. Gearon withdrew their names. The Rules, Confirmation, and Public Elections Committee previously interviewed the candidates and they were found qualified to serve. A vote was taken and the Clerk confirmed the vote as follows: Coleman: Cooper, Gilmore, Hurt, Leonardo, Hastings, Haywood, Scott Davis, Withers, Syracuse, Roberts, Kindall, Murphy, Blalock, Vercher, Karen Johnson, Potts, Dowell, Coleman, Rosenberg (19); Escobar: Mendes, Shulman, Swope, Anthony Davis, Pridemore, Pardue, Freeman, Sledge, Allen, Mina Johnson, Pulley, Elrod, Bedne, Henderson (14); Johnson: VanReece, Glover, O’Connell (3). - RESOLUTIONS ON PUBLIC HEARING-
A resolution exempting Answer Restaurant located at 132 46th Avenue North, from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. The Public Safety, Beer, and Regulated Beverages Committee recommended withdrawal at the request of the sponsor. Ms. Murphy moved to withdraw the resolution, which motion was seconded and adopted by a voice vote of the Council.
- CONSENT AGENDA RESOLUTIONS -
A resolution authorizing the Metropolitan Development and Housing Agency to negotiate and enter into a PILOT Agreement and accept payments in lieu of ad valorem taxes with respect to a multi-family housing project located at 2715 Whites Creek Pike, known as Haynes Garden Apartments. The resolution was approved by the Budget and Finance Committee.
A resolution authorizing and providing for the issuance and sale of general obligation bond anticipation notes in an amount not to exceed $375,000,000 at any one time in the form of commercial paper of The Metropolitan Government of Nashville and Davidson County; authorizing and providing for one or more dealer agreements, issuing and paying agency agreements, and liquidity facility agreements; and providing for certain other matters related thereto. The resolution was approved by the Budget and Finance Committee.
A resolution amending Resolution RS2014-1066 to increase the size and duration of the general obligation extendable commercial paper program of The Metropolitan Government of Nashville and Davidson County. The resolution was approved by the Budget and Finance Committee.
A Twenty-Eighth Supplemental Electric System Revenue Bond Resolution supplementing certain resolutions of The Metropolitan Government of Nashville and Davidson County by authorizing the issuance of Electric System Revenue Bonds, 2017 Series A, and Electric System Revenue Refunding Bonds, 2017 Series B, as requested by the Electric Power Board of The Metropolitan Government of Nashville and Davidson County. The resolution was approved by the Budget and Finance Committee.
A resolution accepting a grant from the State Justice Institute to The Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County Juvenile Court, to provide funding to obtain expert assistance to diagnose a problem, develop a response to that problem, and initiate implementation of any needed changes. The resolution was approved by the Budget and Finance Committee.
A resolution approving Amendment Six to a grant from the State of Tennessee, Department of Human Services, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County Juvenile Court, to establish and enforce federal and state mandated child support program guidelines for children born out of wedlock. The resolution was approved by the Budget and Finance Committee.
A resolution accepting a grant from the State of Tennessee, Department of Correction, to The Metropolitan Government of Nashville and Davidson County, acting by and through the State Trial Courts, for the expenses of housing and treating non-violent felony offenders with co-occurring addiction and mental health disorders. The resolution was approved by the Budget and Finance Committee.
A resolution approving Amendment One to a contract between Election Systems & Software, LLC and the Metropolitan Government of Nashville and Davidson County to extend the contract term. The resolution was approved by the Budget and Finance Committee.
A resolution accepting a grant from Baby+Co. to The Metropolitan Government of Nashville and Davidson County, acting by and through the Sports Authority, to assist with new purchases benefiting the Mamava Project, as outlined in the Sports Authority’s Public Investment Plan. The resolution was approved by the Budget and Finance Committee.
A resolution accepting a grant from the Nashville Sounds Baseball Club to The Metropolitan Government of Nashville and Davidson County, acting by and through the Sports Authority, for the purchase and design of two Mamava Suites, as outlined in the Sports Authority’s Public Investment Plan, for use at First Tennessee Park. The resolution was approved by the Budget and Finance Committee.
A resolution accepting a grant from Southern Blood Services to The Metropolitan Government of Nashville and Davidson County, acting by and through the Sports Authority, to assist with new purchases benefiting the Mamava Project, as outlined in the Sports Authority’s Public Investment Plan. A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to ensure federal preparedness funds are directed to Tennessee Regional and Metropolitan Emergency Preparedness programs to prepare for, respond to, and recover from public health threats. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.
A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to provide the Tennessee Breast and Cervical Screening Program to offer individualized assistance to clients and to facilitate timely access to quality screening and diagnostics.

A resolution approving a business associate agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and Park Center to provide safeguards to prevent the use or disclosure of protected health information. A resolution approving a HIPAA Business Associate Agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and Saint Thomas Health to provide safeguards to prevent the use or disclosure of protected health information. The resolution was approved by the Health, Hospitals, and Social Services Committee.
A resolution approving an agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and the University of Tennessee, College of Veterinary Medicine, to provide clinical experience opportunities for its students. The resolution was approved by the Health, Hospitals, and Social Services Committee.
A resolution approving Amendment Two to an Agreement by and between the Tennessee Department of Transportation and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for improvements on Jefferson Street, Federal No. STP-M-1900(28), State No. 19LPLM-F3-011, PIN 103490. The resolution was approved by the Budget and Finance and Public Works Committees.
A resolution authorizing Mellow PGA, Inc dba Mellow Mushroom to construct and install an aerial encroachment at 423 Broadway for (Proposal No.2017M-014EN-001). The resolution was approved by the Planning Commission, Planning, Zoning, and Historical, and Public Works Committees.
A resolution authorizing Whiskey Row Nashville, LLC to construct and install an aerial encroachment at 400 Broadway for (Proposal No.2017M-017EN-001). The resolution was approved by the Planning Commission, Planning, Zoning, and Historical, and Public Works Committees.
A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of Ramses Vazquez-Marin against the Metropolitan Government of Nashville and Davidson County in the amount of $15,000.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.
A resolution expressing the Metropolitan Council’s encouragement and support for the Native American Indian Association Circle of Life Indian Center. The resolution was approved by the Rules, Confirmation, and Public Elections Committee.

A resolution requesting all officers, department directors, and other heads of all boards, commissions, authorities, and other agencies of Metropolitan Government submitting requests for funds for the ensuing fiscal year for capital improvements to the Director of Finance, as required by the Charter of Metropolitan Government, to submit copies of such requests to the Metropolitan Council at the same time of such submissions to the Director of Finance. A resolution adopting a policy requiring a limitation on the amount of debt service funds appropriated for the amortization of general service bonds and urban service bonds in the annual operating budget of Metropolitan Government in relation to the total expenditures of the annual operating budget for all purposes. The resolution was deferred by the Budget and Finance Committee. The resolution was deferred by rule. In accordance with Rule 23, this resolution was deferred indefinitely.
RESOLUTION NO. RS2017-678
A resolution requesting the Metropolitan Transit Authority to provide at least ten percent (10%) of its advertising space to other Metropolitan departments, boards and commissions to provide public service advertisements regarding local government services. Mr. Bedne offered a substitute resolution and moved that it be accepted for filing, which motion was seconded and adopted by a voice vote of the Council.
SUBSTITUTE RESOLUTION NO. RS2017-678
A resolution requesting the Metropolitan Transit Authority to provide advertising space from its unsold advertising inventory to other Metropolitan departments, boards and commissions to provide public service advertisements regarding local government services. A resolution approving the Metropolitan Animal Care and Control fee schedule. The Budget and Finance Committee approved an amendment. The Budget and Finance and Health, Hospitals, and Social Services Committees recommended deferment. A resolution authorizing the execution of a Cooperation Agreement between The Metropolitan Government of Nashville and Davidson County and the Metropolitan Development and Housing Agency. Mr. Mendes requested a suspension of the rules to allow an amendment to be heard and no objection was made. A resolution accepting a Healthy Out-of-School Grant from the National Recreation and Park Association (NRPA) in partnership with the Walmart Foundation to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Parks and Recreation Department, to increase the number of healthy meals children in low income communities receive, provide nutrition literacy, and implement nutrition standards to access healthier foods. A resolution accepting a grant from the Tennessee Emergency Management Agency to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Water Services Department, for the administration and completion of an approved Flood Mitigation Assistance Project to purchase and remove five houses which lie in various floodplain areas. The Budget and Finance Committee recommended withdrawal and the Public Works Committee took no action. Ms. Vercher moved to withdraw, which motion was seconded and adopted by a voice vote of the Council.

An initial resolution determining to issue general obligation bonds of The Metropolitan Government of Nashville and Davidson County in an aggregate principal amount of not to exceed Two Hundred Eighty-Eight Million Dollars. Ms. Vercher moved to defer the resolution, which motion was seconded and approved by a voice vote of the Council.

A bill to be entitled: The Budget Ordinance of the Metropolitan Government of Nashville and Davidson County, Tennessee for Fiscal Year 2018. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.
An ordinance establishing the tax levy in the general services district for the fiscal year 2017-2018, and declaring the amount required for the annual operating budget of the urban services district, pursuant to section 6.07 of the Metropolitan Charter. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.
An ordinance establishing a program for the purpose of providing assistance to low-income elderly residents of the Metropolitan Government for the fiscal year 2017-2018. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.
An ordinance establishing a Conservation Assistance Grant Fund, appropriating an initial sum to such fund, and amending chapter 2.154 of the Metropolitan Code of Laws with respect to the name, composition, and duties of the Greenways Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Parks, Library, and Recreation Committees by a voice vote of the Council.
An ordinance amending Title 5 to add a requirement for the Department of Finance to maintain a written debt management policy for the metropolitan government. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.
An ordinance amending Title 6, Section 6.72.170, concerning the display of taxicab permits. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Traffic, Parking, and Transportation Committees by a voice vote of the Council.
An ordinance amending Title 6, Chapter 6.81, Booting Services, to add additional application requirements for the qualification of permits and granting authorizing to the Director of the Transportation Licensing Commission and the Transportation Licensing Commission to suspend, revoke, place on probation or otherwise restrict licenses issued to booting companies. Upon motion duly seconded, the bill passed first reading and was referred to the Public Safety, Beer, and Regulated Beverages and Traffic, Parking, and Transportation Committees by a voice vote of the Council.
An ordinance approving an amendment to an agreement between the Metropolitan Government and Piedmont Natural Gas Company, Inc. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.
An ordinance authorizing the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Water and Sewerage Services, hereinafter known as “METRO,” to enter into an agreement with MERITAGE, hereinafter known as “CLOVER GLEN,” to fund the operation and maintenance of a public pressure sewer extension for its development at Clover Glen (Project No. 16-SL-120). Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.
An ordinance authorizing the acquisition of certain right-of-way easements, drainage easements, temporary construction easements, and property rights by negotiation or condemnation for use in public projects of the Metropolitan Government, initially for purposes of Public Works Department Project Number 2016-R-006, Lone Oak Road Sidewalk Improvements (Proposal No. 2017M-032ES-001). The bill was approved by the Planning Commission. An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sanitary sewer main, sanitary sewer manholes and easements and to accept a new sanitary sewer manhole and any associated easements, for property located at 2400 Gallatin Pike (MWS Project No. 16-SL-243 and Proposal No. 2017M-039ES-001). The bill was approved by the Planning Commission. An ordinance readopting the Code of The Metropolitan Government of Nashville and Davidson County, Tennessee, prepared by Municipal Code Corporation, including supplemental and replacement pages thereof, containing certain ordinances of a general and permanent nature enacted on or before February 22, 2017. Upon motion duly seconded, the bill passed first reading and was referred to the Rules, Confirmation, and Public Elections Committee by a voice vote of the Council.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R8 to IWD zoning on property located at 2912 Brick Church Pike, approximately 400 feet south of Brick Church Park Drive (3.92 acres), all of which is described herein (Proposal No. 2017Z-027PR-001). The bill was approved by the Planning Commission.
