RESOLUTION NO. RS2017-708

A resolution approving Amendment Two to an Agreement by and between the Tennessee Department of Transportation and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for improvements on Jefferson Street, Federal No. STP-M-1900(28), State No. 19LPLM-F3-011, PIN 103490.

WHEREAS, the Metropolitan Council previously adopted and approved Agreement No. 080019, by and between the Tennessee Department of Transportation (“TDOT”), and the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Public Works Department through resolution, RS2008-245; and

WHEREAS, based upon the Agreement, TDOT awarded to the Metropolitan Government a grant in the amount not to exceed $920,808.00 with a required match of $480,203.00 by the Metropolitan Government, for intersection improvements on Jefferson Street; and

WHEREAS, Amendment One to Agreement No. 080019 was approved by resolution, RS2013-745 on June 19, 2013, extending the original Agreement to June 1, 2017; specifically identify the two intersections on Jefferson Street which are to be improved, 28th Avenue/Ed Temple and 21st Avenue North, and to better reflect TDOT’s current fund descriptions; and

WHEREAS, the Jefferson Street corridor, from Rosa Parks Blvd. to 28th Avenue/Ed Temple is being studied to determine points along the corridor for improved pedestrian and bicycle safety and mobility in response to the “Every Place Counts” initiative offered by the United States Department of Transportation in Nashville on July 11 and 12, 2016; and

WHEREAS, the study has placed additional recommendations to be considered on the two intersections pending the outcome of the completed study and would prevent full completion of all phases of work in accordance to the terms of Agreement 080019 by June 1, 2017; and

WHEREAS, the parties desire to extend the Agreement as Amendment Two to June 1, 2019; specifically to complete all phases of work identified in Agreement No. 080019.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Amendment Two to the Agreement for Jefferson Street Intersection Improvements, a copy of which is attached hereto and incorporated herein, by and between TDOT and the Metropolitan Government, acting by and through the Department of Public Works, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 3. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
