ORDINANCE NO. BL2017-690

An ordinance approving an agreement between the Metropolitan Government and Bellevue Redevelopment Associates, LP, concerning the exchange of certain parcels of real property in connection with the construction of a new community center and hockey facility in Bellevue (Proposal Number 2017M-030PR-001).

WHEREAS, pursuant to RS2015-64, the Metropolitan Government obtained, by donation, an approximately 2.02-acre parcel of property (the “Civic Parcel”) comprising part of the property (the “Development”) upon which the former Bellevue Mall was located; and,

WHEREAS, the Metropolitan Government proposes to construct a community center and hockey facility within the Development, but the Civic Parcel is not of sufficient size; and,

WHEREAS, pursuant to the agreement (the “Agreement”) attached to this ordinance as Exhibit 1, the Metropolitan Government proposes to obtain an approximately 8.38-acre tract (the “Community Center Property”) within the Development from Bellevue Redevelopment Associates, LP, (“BRA”) in exchange for the Civic Parcel and additional consideration of $2,226,000; and,

WHEREAS, the Community Center Property is appropriately sized and located for use in constructing the planned community center and hockey facility; and,

WHEREAS, approval of the Agreement is in the best interest of the citizens of Davidson County.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Agreement is approved, and the Director of Public Property Administration is authorized to execute the transactions as contemplated therein.

Section 2. The Director of Public Property Administration or his designee is further authorized to execute such documents as are customary and necessary to carry out the intent of this ordinance.

Section 3. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
