The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.
The invocation was offered by Pastor Becky Yates of Dodson Chapel United Methodist Church.
The Metropolitan Council gave the pledge of allegiance to the American Flag.

- ELECTIONS AND CONFIRMATIONS -
Electric Power Board
Reappointment of Ms. Carolyn Schott for a term expiring July 1, 2021. Mr. Shulman moved for confirmation, which motion was seconded and adopted by voice vote of the Council with Mr. Elrod abstaining.
Metropolitan Transit Authority
Appointment of Mr. Colleen Hoy for a term expiring May 1, 2021. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
- CONSENT AGENDA RESOLUTIONS -
A resolution appropriating the amount of $17,406,000.00 from the General Fund Reserve Fund for the purchase of equipment and building repairs for various departments of The Metropolitan Government of Nashville and Davidson County. The resolution was approved by the Budget and Finance Committee.
A resolution increasing the size of the Board of Trustees of the Hospital Authority of the Metropolitan Government of Nashville and Davidson County. The resolution was approved by the Health, Hospitals, and Social Services and Rules, Confirmations, and Public Elections Committees.
A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to ensure federal preparedness funds are directed to Tennessee Regional and Metropolitan Emergency Preparedness programs to prepare for, respond to, and recover from public health threats. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.
A resolution approving Amendment One to the Tennessee Cooperative Agreement to Benefit Homeless Individuals (TN-CABHI) Grant which is a jointly funded program from the State of Tennessee, Department of Mental Health, and Substance Abuse Services to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Social Services Commission, to enhance or develop the infrastructure of Tennessee and the treatment service systems for the population (service recipients). The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.
A resolution accepting an Emergency Solutions Grant from the State of Tennessee, Tennessee Housing Development Agency, to The Metropolitan Government of Nashville and Davidson County for the use and benefit of the Metropolitan Nashville Social Services Commission to provide services to the homeless and those at risk from homelessness. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.
A resolution to appropriate grant funds from the State of Tennessee, Tennessee Housing Development Agency, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Action Commission, for Low Income Home Energy Assistance Program (LIHEAP) services for eligible low income customers. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.
A resolution authorizing The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, to enter into Utility Relocation Contract No. 8588 with the State of Tennessee, Department of Transportation, to construct PIN Number 116103.00, SR-6 (Franklin Road) Intersection at SR-255 (Harding Place Battery Lane) L.M. 3.69 in Oak Hill located in Davidson County, Tennessee, (State Project No. 19005-3159-44 and Project No. 15-SG-01-17 and 15-WG-00-91). The resolution was approved by the Budget and Finance and Public Works Committees.
A resolution authorizing The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Public Works, to enter into Signal Maintenance Agreement No. 150209 with the State of Tennessee, Department of Transportation, to construct PIN number 119739.00, RSAR: I-24 Interchange at SR-171(Old Hickory Blvd), Exit 62, Eastbound Ramp, Ramp Queue Project, State Project No. 19002-3186-94. The resolution was approved by the Public Works Committee.
A resolution requesting the Mayor’s Office of Economic Opportunity and Empowerment to work with the Metropolitan Council’s Ad Hoc Affordable Housing Committee to develop and implement a comprehensive plan to address the issue of housing affordability in Nashville and Davidson County. The resolution was approved by the Ad Hoc Affordable Housing and Planning, Zoning, and Historical Committees.
A resolution of the Metropolitan Council of Nashville and Davidson County calling upon the Tennessee General Assembly to adopt enhanced state regulation of large scale commercial dog breeders a/k/a “puppy mills.” The resolution was approved by the Health, Hospitals, and Social Services Committee.

A resolution recognizing Mr. Chris Henson for his service to Nashville and the Metropolitan School System. The Education Committee deferred by rule.
A resolution requesting the Public Works Department to provide the Metropolitan Council with an updated list of sidewalks and proposed sidewalks around Metro Nashville Public Schools. The Education and Public Works Committees recommended deferment. Mr. Shulman moved to defer the resolution, which motion was seconded and approved by a voice vote of the Council.
- BILLS ON INTRODUCTION AND FIRST READING –
An ordinance amending Title 3 of the Metropolitan Code relative to employee benefits to comply with state law regarding assignment of retirement plans benefits pursuant to a qualified domestic relations order (“QDRO”). Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Personnel, Public Information, Human Relations, and Housing Committees by a voice vote of the Council.
An ordinance amending Title 6, Chapter 6.72 – Taxicabs. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Public Works, and Traffic, Parking, and Transportation Committees by a voice vote of the Council.
An ordinance amending Section 7.08.090 of the Metropolitan Code to broaden application of the minimum distance requirements and to eliminate the minimum distance exemption for a restaurant located within the boundaries of Sixth Avenue North, Union Street, Fifth Avenue North, and Church Street. Upon motion duly seconded, the bill passed first reading and was referred to the Public Safety, Beer, and Regulated Beverages Committee by a voice vote of the Council.
An ordinance amending sections 15.34.030 and 15.34.040 of The Metropolitan Code of Laws pertaining to Residential Sanitary Sewerage Pumping Systems (“RSSP”). Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.
An ordinance approving an agreement between the Metropolitan Government of Nashville and Davidson County and Nashville Steam Preservation Society for the lease and restoration of Steam Locomotive Number 576. Upon motion duly seconded, the bill passed first reading and was referred to the Parks, Library, and Recreation Committee by a voice vote of the Council.
An ordinance authorizing the Metropolitan Government of Nashville and Davidson County to accept a donation of $50,000 from Mapco Express, Inc., to aid in the modification of traffic signals at the intersection of Robinson Road and Merritt Street (Project No. 2016-R-32). Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.
BILL NO. BL2016-334
An ordinance amending BL2015-1281, which authorizes the Metropolitan Development and Housing Agency to negotiate and accept payments in lieu of ad valorem taxes from its lessees operating low income housing tax credit properties pursuant to Tennessee Code Annotated 13-20-104 and revising the program for determining qualifications and eligibility for such payments. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.
An ordinance to establish the Inclusionary Housing Fund (“Fund”) and to appoint the Barnes Fund as the administrator of that Fund. Ms. Weiner moved to withdraw the bill, which motion was seconded and adopted by a voice vote of the Council.
An ordinance to allow a local business preference on competitive bidding and to allow matching of low bids. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.
An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon an existing sewer main and to accept new sewer main and two new manhole assemblies for property located at 1200 Jo Johnston Avenue (MWS Project16-SL-0090 and Proposal No. 2016M-026ES-001). The bill was approved by the Planning Commission. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a and RS15 to SP zoning for properties located at Mt. Pisgah Road (unnumbered) and 6000 and 6021 Mt. Pisgah Road, approximately 750 feet west of Christiansted Lane (12.12 acres), to permit 31 single family lots, all of which is described herein (Proposal No. 2016SP-011-001). The bill was approved by the Planning Commission with conditions, disapproved without. (“Lessor”) for temporary office space at 3055 Lebanon Pike, Nashville, Tennessee (Proposal No. 2016M-012PR-001). The bill was approved by the Planning Commission and the Budget and Finance Committee; the Planning, Zoning, and Historical, and Public Safety, Beer, and Regulated Beverages Committees approved the bill with an amendment. Mr. Rhoten offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Rhoten moved to pass the bill on second reading as amended, which motion was seconded and approved by a voice vote of the Council with Mr. Mendes abstaining.
An ordinance to amend Chapter 2.32 of the Metropolitan Code to require the Office of Fleet Management, under the Department of General Services, to adopt the necessary rules and policies that prioritize the servicing and repair of police vehicles, fire engines, and other emergency response vehicles. At the request of the sponsor, the Public Safety, Beer, and Regulated Beverages Committee recommended indefinite deferment. Mr. Hagar moved to defer the bill indefinitely, which motion was seconded and approved by a voice vote of the Council.
An ordinance amending Chapter 2.149 of the Metropolitan Code to require residential rental properties receiving allocations from the Barnes Fund to include language concerning tenant conduct in the rental agreement. The Codes, Fair, and Farmers Market and Personnel, Public Information, Human Relations, and Housing Committees recommended deferral. Mr. Hastings moved to defer the bill, which motion was seconded and approved by a voice vote of the Council.
An ordinance to amend Section 6.26.030.B.5. of the Metropolitan Code of Laws regarding public proceedings for franchises for fiber optic communications services. The bill was approved by the Budget and Finance, Planning, Zoning, and Historical, and Public Works Committees. Mr. Pridemore moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.
An ordinance amending Ordinance No. 092-415, pertaining to the creation and membership of the Justice Information System of the Metropolitan Government. The bill was approved by the Budget and Finance Committee. Mr. Pridemore moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.
An ordinance requiring Metropolitan Council approval by resolution of the location of the Sheriff’s new administrative offices facility prior to the disbursement of general obligation bond funds, commercial paper, or any other funding toward this project.

The Planning, Zoning, and Historical Committee recommended deferment to the first meeting in October and re-referral to the Planning Commission. The Planning, Zoning, and Historical Committee recommended deferment to the second meeting in August. Mr. Scott Davis moved to defer the bill to the second meeting in August, which motion was seconded and approved by a voice vote of the Council.
