ORDINANCE NO. BL2016-330

An Ordinance amending Section 7.08.090 of the Metropolitan Code to broaden application of the minimum distance requirements and to eliminate the minimum distance exemption for a restaurant located within the boundaries of Sixth Avenue North, Union Street, Fifth Avenue North, and Church Street.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 7.08.090 of the Metropolitan Code of Laws is hereby amended by deleting the second sentence of subsection 7.08.090.A.1, which begins: “One- or two family dwellings…”, and substituting therefor the following:

One- or two-family dwellings shall not be construed to include house trailers, on wheels or otherwise. Provided, however, that the minimum distance requirements contained herein shall not be applicable to any location which is in the DTC or CF zone districts.

Section 2. That Section 7.08.090 of the Metropolitan Code of Laws is hereby further amended be deleting subsection F thereof in its entirety, and re-numbering the remaining sections as necessary.

Section 3. That this Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
