ORDINANCE NO. BL2016-332

An ordinance approving an agreement between The Metropolitan Government of Nashville and Davidson County and Nashville Steam Preservation Society for the lease and restoration of Steam Locomotive Number 576.

WHEREAS, The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Parks and Recreation, is the rightful owner of Steam Locomotive Number 576 (the “Locomotive”), which is currently located in Centennial Park; and,

WHEREAS, the Nashville Steam Preservation Society (“NSPS”), a Tennessee non-profit organization, contemplates leasing the Locomotive from The Metropolitan Government of Nashville and Davidson County; and,

WHEREAS, NSPS intends to restore the Locomotive to make it operational and to allow visitors and citizens of Nashville to ride on runs of the Locomotive; and,

WHEREAS, The Metropolitan Government of Nashville and Davidson County and NSPS have negotiated the attached lease agreement, attached as Exhibit 1; and,

WHEREAS, entering into this Lease Agreement is in the best interest of the citizens of the Metropolitan Government.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The agreement between The Metropolitan Government of Nashville and Davidson County and Nashville Steam Preservation Society for the lease and restoration of Steam Locomotive Number 576, attached hereto as Exhibit 1 and incorporated herein, is hereby approved.

Section 2. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
