ORDINANCE NO. BL2016-313

An ordinance approving a license agreement between The Metropolitan Government of Nashville and Davidson County, by and through the Department of Parks and Recreation, and the State of Tennessee, acting by and through its Commissioner of Transportation, to construct and maintain a multi-use pedestrian greenway in Davidson County, Tennessee (Proposal No. 2016M-004OT-001).

WHEREAS, the Metropolitan Government of Nashville and Davidson County, acting through its Department of Parks and Recreation, desires to enter into a license agreement with the State of Tennessee Department of Transportation to use a portion of the Licensed Premises described in Exhibit A attached hereto, to construct and maintain a multi-use pedestrian greenway in Davidson County, Tennessee; and,

WHEREAS, the license agreement is attached hereto and incorporated herein; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that the license agreement be approved.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: The license agreement between The Metropolitan Government of Nashville and Davidson County, by and through the Department of Parks and Recreation, and the State of Tennessee, acting by and through its Commissioner of Transportation, a copy of which is attached hereto and incorporated herein, is hereby approved and the Metropolitan Mayor is authorized to execute the same.

SECTION 2: That any amendments, renewals or extensions of the terms of the license agreement shall be approved by Resolution of the Metropolitan Council receiving at least twenty-one (21) affirmative votes.

SECTION 3: That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
