ORDINANCE NO. BL2016-303

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon an existing sewer main and easement and to accept new sewer mains for property located at 12th Avenue North and Broadway (MWS Project No. 15-SL-224 and Proposal No. 2016M-024ES-001).

WHEREAS, the abandonment of approximately 108 linear feet of an existing 10 inch sanitary sewer main and approximately 209 linear feet of an existing 42 inch sanitary sewer main and easement and the acceptance of approximately 109 linear feet of new 60 inch by 38 inch combined sewer main and approximately 229 linear feet of new 48 inch combined sewer main and four new combined sewer manholesS for property located at 12th Avenue North and Broadway are needed to construct project number 15-SL-224 and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2016M-024ES-001 on May 19, 2016, for the abandonment and acceptance of said sewer mains and four new sewer manholes and easements;

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 108 linear feet of an existing 10 inch sanitary sewer main and approximately 209 linear feet of an existing 42 inch sanitary sewer main and easement and to accept approximately 109 linear feet of new 60 inch by 38 inch combined sewer main and approximately 229 linear feet of new 48 inch combined sewer main and four new combined sewer manholes for property located at 12th Avenue North and Broadway, as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
