ORDINANCE NO. BL2016-255

An ordinance to amend Chapter 2.32 of the Metropolitan Code to require the Office of Fleet Management, under the Department of General Services, to adopt the necessary rules and policies that prioritize the servicing and repair of police vehicles, fire engines, and other emergency response vehicles.

WHEREAS, pursuant to Chapter 2.32.030 of the Metropolitan Code, the functions and duties for the operation of garages and service centers for the repair of automotive equipment is now under the direction of the Department of General Services; and,

WHEREAS, pursuant to Chapter 2.32.060 of the Metropolitan Code, the Office of Fleet Management has the authority to adopt rules and regulations pertaining to the use and operation of Metro vehicles and equipment; and,

WHEREAS, it is in the best interest of the Metropolitan Government of Nashville and Davidson County to authorize the Director of the Department of General Services (the Director) and the Office of Fleet Management to adopt rules, standards, and policies that prioritize the servicing and repair of police vehicles, fire engines, and emergency response vehicles, including, but not limited to, ambulances, such that those vehicles will be returned to service as quickly as possible.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Chapter 2.32 of the Metropolitan Code of Laws is amended by adding thereto a new Section 2.32.070 stating as follows:

2.32.070 Priority of repair and servicing of metropolitan government vehicles

A. In providing maintenance upon metropolitan government vehicles and equipment, the Office of Fleet Management shall adopt written rules, standards, and policies that establish, as a priority, the servicing and repair of police vehicles, fire engines, and other emergency response vehicles. Such rules, standards, and policies shall be in place no later than December 31, 2016 and the implementation of that prioritization shall be in place and followed no later than January 1, 2017.

B. The Office of Fleet Management shall provide a Report to the Public Safety Committee of the Metropolitan Council no later than April 30 of each year regarding the types of vehicles serviced and repaired during the prior calendar year. Said report shall include the date and length of time that the priority vehicles, as set forth in subsection A, are undergoing servicing and repair.

Section 2. This ordinance shall take effect upon its adoption, the public welfare requiring it.
