ORDINANCE NO. BL2016-331

An ordinance amending sections 15.34.030 and 15.34.040 of The Metropolitan Code of Laws pertaining to Residential Sanitary Sewerage Pumping Systems (“RSSP”).

WHEREAS, Metropolitan Code of Laws Section 15.34.030(C) provides for a one-time nonrefundable maintenance fee of two thousand five hundred dollars for developer installation of a Residential Sanitary Sewerage Pumping System; and,

WHEREAS, Metropolitan Code of Laws Section 15.34.030(C) has not been amended since 1998 and the one-time nonrefundable maintenance fee needs to be amended to accurately reflect the cost of Metro Water Services maintaining the Residential Sanitary Sewerage Pumping System; and,

WHEREAS, Section 15.34.040, Installation, does not currently require an odor control system when installing a Residential Sanitary Sewerage Pumping System; and,

WHEREAS, it is in the best interest of citizens of the Metropolitan Government of Nashville and Davidson County that homeowners and developers install appropriately designed odor control systems installing a Residential Sanitary Sewerage Pumping System.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Code of Laws § 15.34.030(C) shall be amended by deleting it in its entirety and replacing it with the following: “Maintenance Fee. Developer installation of a RSSP will require the payment of a one-time nonrefundable maintenance fee as set by the Wastewater Hearing Authority. The initial fee will remain two thousand five hundred dollars until revised by the Wastewater Hearing Authority. This fee will not be required for department installations nor for homeowner installations, except as provided in Section 15.34.050C.”

Section 2. The Metropolitan Code § 15.34.040(B) shall be amended by deleting it in its entirety and replacing it with the following: “For homeowner and developer installations, the installation cost for a (RSSP) will be totally funded by the respective homeowner/developer. All installations must be in compliance with the department's specifications including an appropriately designed odor control system at the point of discharge of the collector force main. The system must be designed by a licensed engineer and approved by the Department including any perpetual easement, permanent structure, power and telemetry.”

Section 3. The Metropolitan Code § 15.34.040(C) shall be replaced with the following:
“As determined by the director or his designee, the installer of a RSSP system will be required to install resistant pipe materials or liners and apply manhole sealers, upstream and downstream from the discharge point, to protect the public sanitary sewer system from corrosive gases that may be generated by the (RSSP) system. The installer shall also install an appropriately sized odor control system based on site conditions as determined by the director or his designee at the point of discharge to the gravity sewer system at the installer’s expense. The system must be designed by a licensed engineer and approved by the Department including a perpetual easement, permanent structure, power and telemetry.”

Section 4. Amendments to this legislation shall be approved by resolution.

Section 5. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1
TO
ORDINANCE NO. BL2016-331

Mr. President –

I move to amend Ordinance No. BL2016-331as follows:

I. By deleting the first recital in its entirety and replacing it with the following:

WHEREAS, Metropolitan Code of Laws Section 15.34.030(C) provides for a one-time nonrefundable maintenance fee of two thousand five hundred dollars for developer installation of a Residential Sanitary Sewerage Pumping System per residential connection; and,

II. By amending Section 1 by deleting it in its entirety and substituting therefore the following:

Section 1. The Metropolitan Code of Laws § 15.34.030(C) shall be amended by deleting it in its entirety and replacing it with the following: “Maintenance Fee. Developer installation of a RSSP will require the payment of a one-time nonrefundable maintenance fee per residential connection as set by the Wastewater Hearing Authority. The initial fee will remain two thousand five hundred dollars until revised by the Wastewater Hearing Authority. This fee will not be required for department installations nor for homeowner installations, except as provided in Section 15.34.050C.”
