ORDINANCE NO. BL2016-338

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon an existing sewer main and manholes and to accept new sewer main, manholes and new water main and fire hydrant for property located at 501 5th Avenue South (MWS Project 15-SL-115 and 15-WL-88 and Proposal No. 2016M-027ES-001).

WHEREAS, the abandonment of approximately 94 linear feet of an existing eight inch sanitary sewer main and two sewer manholes and the acceptance of approximately 94 linear feet of new 12 inch sanitary sewer main, three manholes, approximately 61 linear feet of new eight inch public water main and one fire hydrant assembly for property located at 501 5th Avenue South, are needed to construct project number 15-SL-115 and 15-WL-88; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2016M-027ES-001 on June 27, 2016, for the abandonment and acceptance of said sewer mains, manholes, water main and fire hydrants.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 94 linear feet of an existing eight inch sanitary sewer main and two sewer manholes and to accept approximately 94 linear feet of 12 inch sanitary sewer main, three manholes, approximately 61 linear feet of eight inch public water main and one fire hydrant for property located at 501 5th Avenue South, as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
