RESOLUTION NO. RS2016-315

A resolution authorizing The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, to enter into Utility Relocation Contract No. 8588 with the State of Tennessee, Department of Transportation, to construct PIN Number 116103.00, SR-6 (Franklin Road) Intersection at SR-255 (Harding Place Battery Lane) L.M. 3.69 in Oak Hill located in Davidson County, Tennessee (State Project No. 19005-3159-44 and Project No. 15-SG-01-17 and 15-WG-00-91).

WHEREAS, the State of Tennessee, Department of Transportation (“TDOT”) plans to construct Project No., 15-SG-01-17 and 15-WG-00-91, PIN Number 116103.00, SR-6 (Franklin Road) Intersection at SR-255 (Harding Place Battery Lane) L.M. 3.69 in Oak Hill, located in Davidson County, which will require the relocation of utilities as described in Utility Relocation Contract No. 8588, attached hereto as Exhibit A, and,

WHEREAS, The Metropolitan Department of Water and Sewerage Services plans to construct the utility work identified as Project No. 15-SG-01-17 and 15-WG-00-91, WG-00-91; and,

WHEREAS, pursuant to the terms of Utility Relocation Contract No. 8588, attached hereto as Exhibit A, the Metropolitan Government of Nashville and Davidson County will be responsible for one hundred percent (100%) of the actual cost for the utility work, which is currently estimated to be $150,000.00. This amount is expected to be funded from existing balances on deposit in the Metropolitan Department of Water and Sewerage Services Local Government Investment Pool (“LGIP”) account with the State of Tennessee; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104(a)(2)(b), authorizes The Metropolitan Government of Nashville and Davidson County to approve an agreement with TDOT by resolution; and,

WHEREAS, it is in the interest of the Metropolitan Government of Nashville and Davidson County that this utility work be carried out in State Project No. 19005-3159-44.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Utility Relocation Contract No. 8588 with TDOT, attached hereto as Exhibit A and incorporated herein by reference, is hereby approved, and that the Director of the Department of Water and Sewerage Services is authorized to execute the same.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
