The Metropolitan Council gave the pledge of allegiance to the American Flag.

Dear Vice Mayor Briley and Members of the Council:
Please find attached the State of Tennessee reporting form required to be submitted to the local legislative body following a sale of bonds. This report is for the sale of $343,975,000 General Obligation Refunding Bonds, Series 2016, authorized by the Metropolitan Council by Resolution No. RS2016-101. The bonds closed on June 1, 2016.
Total savings will be $19,466,141 with a present value savings of $16,270,215 which equates to a 4.84% present value savings, far in excess of Metro’s debt policy threshold of 3.5%. In February, the Metro Council authorized the sale of the refunding of these bonds, and the final result of the negotiations was a savings of $824,000 more in present value over what was anticipated earlier this year.
As always, we appreciate the Metropolitan Council’s support on these important financing initiatives.

Reappointment of Ms. Kasey Anderson for a term expiring April 30, 2019. At the requested of the appointee, the nomination was deferred.
Metropolitan Nashville Airport Authority
Appointment of Mr. Kabir Sandhu for a term expiring April 6, 2018. Mr. Sandhu will fill the unexpired term of Ms. Juli Mosley. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
CATV Special Committee
Appointment of Mr. Ross Pepper for a term expiring March 1, 2019. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
Convention Center Authority
Appointment of Mr. David McMurry for a term expiring January 21, 2018. Mr. McMurry will fill the unexpired term of Mr. Waverly D. Crenshaw, Jr. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

A resolution confirming the appointment of David McMurry to serve on the board of directors of The Convention Center Authority of the Metropolitan Government of Nashville and Davidson County for the remainder of the unexpired term of Waverly D. Mr. Pridemore requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. Documents were filed as part of the record. The President declared the public hearing closed. Mr. Pridemore moved to pass the bill on second reading and re-refer the bill to the Budget and Finance Committee, which motion was seconded and approved by a voice vote of the Council.
An ordinance adopting the 2016-2017 through 2021-2022 Capital Improvements Budget for The Metropolitan Government of Nashville and Davidson County as the official Capital Improvements Budget of The Metropolitan Government of Nashville and Davidson County for Fiscal Year 2016-2017. The bill was approved by the Planning Commission, Budget and Finance and Planning, Zoning, and Historical, Committees. Mr. Pridemore requested a hearing from the public on this bill which had been previously advertised. - CONSENT AGENDA RESOLUTIONS -
A resolution accepting a grant from the State of Tennessee, Department of Mental Health and Substance Abuse Services, to The Metropolitan Government of Nashville and Davidson County for the State Trial Courts to provide the Tennessee Certified Recovery Court Program (TCRCP) to enable the establishment of adult and juvenile drug court programs to address the needs of non-violent offenders with addiction and/or co-occurring mental health needs. The resolution was approved by the Budget and Finance Committee.
A resolution authorizing the Mayor to execute a mutual commitment letter with the 100 Resilient Cities Network for participation in the 100 Resilient Cities Challenge program to help cities around the world build resilience to economic, social, and physical challenges that are increasingly part of the 21st century. The bill was approved by the Budget and Finance Committee.
A resolution approving an application for a Family Justice Center Advocate/Navigator Grant from the State of Tennessee, Office of Criminal Justice Programs, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Office of Family Safety, for funding for an advocate/navigator position to assist clients as they enter the Family Justice Center and to help with data collection. A resolution approving an application for a Port Security Grant from the U.S. Department of Homeland Security to The Metropolitan Government of Nashville and Davidson County, acting by and through the Office of Emergency Management, to mitigate an equipment shortfall within the Port of Nashville by adding one National Incident Management System (NIMS) response package for Radiological/Nuclear Detection (RND). A resolution approving an application for the Four-Forty Greenway TIGER VIII Grant from the U.S. Department of Transportation to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation, to construct the Four-Forty Greenway from Melrose/Battlemont Park to Boyd Park. A resolution approving an application for a Legacy Southeast Park Grant from the State of Tennessee, Department of Environment and Conservation, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Parks and Recreation Department, to develop a Celebrate Southeast Events Field to include a covered pavilion, open air plaza, and lawn/multi-use recreation field. A resolution authorizing The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, hereinafter called the “Licensee,” to enter into an Agreement For Utility Crossing with the Nashville and Eastern Railroad Corporation, hereinafter called “Licensor” to construct and maintain a water line until the year 2053 under the right-of-way and trackage of Licensor at milepost 7.74 in Donelson (Project No. 14WC0072). A resolution authorizing RC Mathews Contractor LLC to construct and install an aerial encroachment at 315 Union Street for (Proposal No.2015M-033EN-001). The bill was approved by the Planning Commission, Planning, Zoning, and Historical, and Public Works Committees.
A resolution authorizing CT Nashville, LLC dba Crazy Town to construct and install an aerial encroachment at 308 Broadway (Proposal No.2016M-015EN-001). The resolution was approved by the Planning Commission, Planning, Zoning, and Historical, and Public Works Committees.
A resolution authorizing the Metropolitan Department of Law to compromise and settle the Metropolitan Government’s property damage claim against Hardaway Construction Corp. and 3Form LLC in the amount of $75,000.00. The resolution was approved by the Budget and Finance Committee.
A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of Brazella Northern against the Metropolitan Government of Nashville and Davidson County in the amount of $18,000.00. The resolution was approved by the Budget and Finance Committee.
A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of Maria Patino against the Metropolitan Government of Nashville and Davidson County in the amount of $11,000.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.
A resolution approving the election of certain Notaries Public for Davidson County. The resolution was approved by the Rules, Confirmations, and Public Elections Committee.
A resolution recommending that the Metropolitan Transportation Licensing Commission amend its Rules and Procedures to restrict the issuance of licenses, permits and/or certificates for vehicles-for-hire to those vehicles that are in compliance with Tennessee vehicle registration requirements. The resolution was approved by the Public Works and Traffic, Parking and Transportation Committees.

A resolution requesting amendment to Regulation No. 3 of the Metropolitan Board of Health, Division of Pollution Control, regarding new source review. The Health, Hospitals, and Social Services Committee recommended the resolution be deferred to the first meeting in July at the request of the sponsor. Mr. Bedne moved to defer the resolution to the first meeting in July, which motion was seconded and approved by a voice vote of the Council.
Initial resolution determining to issue general obligation bonds of The Metropolitan Government of Nashville and Davidson County in an aggregate principal amount of not to exceed Four Hundred Seventy-Five Million Dollars. The resolution was approved by the Budget and Finance Committee. Mr. Pridemore moved to defer the resolution and re-refer it to the Budget and Finance Committee, which motion was seconded and approved by a voice vote of the Council.
A resolution granting the Purchasing Agent and Information Technology Services the authority to extend a contract with Presidio Networked Solutions, Inc. for up to an additional two years. The Budget and Finance Committee recommend withdrawal. Mr. Pridemore moved to withdraw the resolution, which motion was seconded and adopted by a voice vote of the Council.
A resolution approving a contract by and between The Metropolitan Government of Nashville and Davidson County and Central States Bus Sales Inc., for the lease of buses. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees with an amendment. Mr. Pridemore offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. A Resolution requesting that the Metropolitan Planning Department prepare and/or submit to the Metropolitan Council maps depicting current locations of federally subsidized housing developments by 50%, 60%, 80%, 120% AMI, as well as affordable and workforce housing units in Nashville & Davidson County. RESOLUTION NO. RS2016-270
A resolution requesting the Employee Benefit Board to establish and implement a parental and sick leave policy allowing maternity and paternity leave for employees of the Metropolitan Government of Nashville & Davidson County. Mr. Anthony Davis offered a substitute resolution and moved that it be accepted for filing and which motion was seconded and adopted by a voice vote of the Council.
SUBSTITUTE RESOLUTION NO. RS2016-270
A resolution requesting the Civil Service Commission to establish and implement a parental and sick leave policy allowing maternity and paternity leave for employees of the Metropolitan Government of Nashville & Davidson County. The resolution was approved by the Budget and Finance Committee; the Personnel, Public Information, Human Relations, and Housing Committee approved the resolution and recommended deferment. Mr. Anthony Davis moved to defer the resolution to the first meeting in July, which motion was seconded and approved by a voice vote of the Council.
- BILLS ON INTRODUCTION AND FIRST READING –
An ordinance to amend various sections of Title 17 of the Metropolitan Zoning Code to incentivize Inclusionary Housing with any residential development that seeks additional development entitlements beyond that permitted by the current base zoning district (Proposal No. 2016Z-001TX-001). Ms. Allen moved to defer the bill to the first meeting in July, which motion was seconded and approved by a voice vote of the Council.
An ordinance authorizing the Director of Public Property to enter into a Sublease Agreement (attached as Exhibit 1) and a Consent by Lessor to Sublease Agreement (attached as Exhibit B to the Sublease Agreement) with Active Network, LLC (“Sublessor”) and Donelson Corporate Centre, L.P. (“Lessor”) for temporary office space at 3055 Lebanon Pike, Nashville, Tennessee (Proposal No. 2016M-012PR-001). Mr. Rhoten moved to defer the bill to the first meeting in July, which motion was seconded and approved by a voice vote of the Council.
An ordinance to amend Chapter 2.32 of the Metropolitan Code to require the Office of Fleet Management, under the Department of General Services, to adopt the necessary rules and policies that prioritize the servicing and repair of police vehicles, fire engines, and other emergency response vehicles. Upon motion duly seconded, the bill passed first reading and was referred to the Public Safety, Beer, and Regulated Beverages Committee by a voice vote of the Council.
An ordinance amending Title 16 of The Metropolitan Code, Buildings and Construction, Property Standards, by amending Section 16.04.172 and Section 16.24.190 to clarify the basis for the denial of permits to applicants guilty of and in current violation of Title 16, all of which is more particularly described herein. Upon motion duly seconded, the bill passed first reading and was referred to the Codes, Fair, and Farmers Market Committee by a voice vote of the Council.
An ordinance amending Section 16.04.1110 and Section 6.28.030 of the Metropolitan Code of Laws regarding noncompliance with Title 16 and the penalties therefor. Upon motion duly seconded, the bill passed first reading and was referred to the Codes, Fair, and Farmers Market by a voice vote of the Council.
An ordinance authorizing the conveyance of the Metropolitan Government’s interest in the building and parcel of property located at 225 Polk Avenue (Proposal Number 2016M-017PR-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Planning, Zoning, and Historical Committees by a voice vote of the Council.
An ordinance to require that the Metropolitan Transit Authority, in conjunction with any other related entities, provide to the Metropolitan Council, no later than December 31, 2016, a comprehensive mass transit plan for Nashville and Davidson County. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Traffic, Parking and Transportation Committees by a voice vote of the Council.
An ordinance readopting the Code of The Metropolitan Government of Nashville and Davidson County, Tennessee, prepared by Municipal Code Corporation including supplemental and replacement pages thereof, containing certain ordinances of a general and permanent nature enacted on or before April 20, 2016. Upon motion duly seconded, the bill passed first reading and was referred to the Rules, Confirmations, and Public Elections Committee by a voice vote of the Council.
An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon an existing sewer main and easement and to accept one new sewer manhole assembly and easement for property located at 420 Donelson Pike (MWS Project No. 16-SL-0043 and Proposal No. 2016M-023ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical and Public Works Committees by a voice vote of the Council.
An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sewer main and easement and to accept new sewer main and easement for properties located at 800 and 802 Marquette Drive (MWS Project No. 16-SG-0059 and Proposal No. 2016M-021ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical and Public Works Committees by a voice vote of the Council.
An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon easement rights that were previously retained by Council Bill No. 2015-1020 within the right of way of Alley No. 160 for properties located at 710 and 706 Division Street (Proposal No. 2016M-022ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical and Public Works Committees by a voice vote of the Council.
An ordinance authorizing the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Water and Sewerage Services, hereinafter known as “Metro,” to participate with Eugene H. Nelson hereinafter known as “Nelson,” to provide public water service improvements for Nelson’s proposed development, as well as other existing properties in the area (Project No. 15-WL-0153). An Ordinance amending Section 17.40.120 of Title 17 of the Metropolitan Code, Zoning Regulations, pertaining to the determination of inactivity of a planned unit development, all of which is more particularly described herein. SUBSTITUTE BILL NO. BL2016-234
An ordinance amending various sections of Chapter 10.56 of the Metropolitan Code of Laws to allow additional information requirements under section 10.56.020.A.1, and to add Metropolitan Zoning Code compliance to the provisions of section 10.56.020H. The Codes, Fair, and Farmers Market, Committee made no recommendation; the Health, Hospitals, and Social Services Committee recommended deferment at the request of the sponsor.
