ORDINANCE NO. BL2016-224

An ordinance granting the Purchasing Agent the authority to extend the terms of contract numbers 19448 and 19572 for program and construction management services pertaining to the Department of Water and Sewerage Services overflow abatement consent decree program.

WHEREAS, The Metropolitan Government of Nashville and Davidson County has been under a Consent Decree from the United States Environmental Protection Agency and the Tennessee Department of Environment and Conservation since 2009 to reduce overflows from the combined and separate sewer system; and,

WHEREAS, the capital program to address the issues raised in the Consent Decree consists of 110 different projects for which the program management and construction management services were competitively procured and awarded for terms of sixty (60) months; and,

WHEREAS, contract number 19448 for program management services was awarded to Camp Dresser & McKee, Inc., now known as CDM Smith, Inc., in late 2011 with provisions for extending the contract if approved by the Metropolitan Council; and,

WHEREAS, contract number 19572 for construction management services was awarded to Gresham Smith & Partners in early 2012 with provisions for extending the contract if approved by the Metropolitan Council; and,

WHEREAS, the Metropolitan Government’s current contracts with Gresham Smith & Partners, and CDM Smith, Inc., will expire in a few months.

WHEREAS, section 4.12.160(A) of the Metropolitan Code limits the term of contracts for services to sixty (60) months, unless otherwise authorized by the Metropolitan Council; and,

WHEREAS, due to the magnitude and specificity of the capital projects required to address the matters in the Consent Decree, the Director of the Department of Water and Sewerage Services and the Purchasing Agent have recommended that contract numbers 19448 and 19572 for program and construction management services be extended for up to an additional seven (7) years; and,

WHEREAS, it would be in the best interest of the Metropolitan Government for the Purchasing Agent to have the option to extend the terms of contract numbers 19448 and 19572.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Purchasing Agent is hereby authorized to extend contract number 19448 for program management and contract number 19572 for construction management services for up to seven (7) additional years, if the Purchasing Agent determines that such extension is in the best interest of the Metropolitan Government.

Section 2. That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
